Timeline

My friend is a permanent resident married to a US citizen .She has 3 children with age 16,17 and 18,but when her husband applied for her AOS,did not apply for her children.So,can he apply for them now,or just she can do it? What form is necessary just the 130 or the 325 also?Thanks

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

She got married in 2009 in US to an US citizen.She came by tourist visa .Her children were 15,14 and 13 when she got married here.The kids were in Brazil and never came to US.When her husband applied for her green card,he could not apply for her children in same time,because the kids father did not want to give authorization for them to live here.But just now,the kids father gave authorization and they have passports,everything.So my friend wants to know who will be the petitioner,she or her husband because when they got married,the kids were 15,14 and 13 years old.What forms ? How long the kids will be here? Thanks

Read the Guides (button at top of this page).

US citizen stepparent files separate Form I-130 for the children to start with. The I-130 is the first step. As things progress, three will a few more forms; I-864, DS-230, etc.
