Timeline

immigration hold is normal, if a uscis officer shows up and runs her, sees her in status, she's released from immigration hold.

figure 24 to 72 hours for that.

if i were in your shoes, i'd leave her there.

tuesday, file for divorce and restraining order.

This took a whole different turn....

We agreed to do a summary dissolution, but two days short of planning to go, she attacked me (not first time though) for silly things and she called police for first time, I guess thinking she could fabricate a story and pretend to be the victim, the police came and of course they saw all the evidence in the home and my physical damage on my body cause I only defend myself and they took her to jail. they asked if I should press charges, I said yes cause it would happen again and she has threatened me enough.

Do as Darnell said. Lawyer up ASAP. This is actually the best thing that could have happened, but you must protect yourself. This chick has had American woman trianing.

Ill try to get the restraining order today. I doubt I can file for divorce first, I think it first is family law (domestic violence) but I will go to court to get restraining order if possible today.

Maybe the bail bonds group thinks she is illegal or something and said she will be deported back to China... during the immigration hold.

but when USCIS officer checks she has conditional green card, then I guess she is off hold, but I am sure she is still stuck in jail cause no bond has been paid.

But they are now trying to contact her parents and see if they will pay up. I hope they dont, but if they do, I better have my restraining order ASAP.

But it appears she is now being tried for a felony instead of a misdemeanor, does that affect the conditional green card? I am thinking you cannot commit a felony or even a misdemeanor on one in order to keep it valid?

Timeline

the immigration officer will decide if she's to be held over for an immigration court proceeding,

but that usually occurs (the proceeding)

after

she's been convicted of that felony charge.

If she's not convicted, then immigration court 'focus' lessens.

It's not some 1 day process - this takes some time, as court dockets and calendars are quite slow.

you should have the paper work put into the court ASAP. if she harasses/provokes you inbetween, you have your filing records to bring to the police attention.

if you are serving a court order, MAKE SURE YOU have the police/sheriff to serve it. otherwise she can say you had never served her the court order.

FWIW, this is straight out of the VAWA* playbook and I am happy to see it backfire on her, irrespective of what her true intentions may or may not be.

She has arraignment tomorrow and I found a family lawyer and will have my first meeting with them tomorrow and see how that goes (domestic violence/divorce) bringing in all evidence tomorrow, but kinda sad I emptied out my GUZ visa interview binder box to use it now for my divorce/domestic violence process.

Make sure your lawyer is on your side and not hers. After having been through one divorce I found that the lawyers are in it together to drain your wallet. If there is any sign that your lawyer is compromising what you want get another one. I found it best to get one from out of your county. It may cost a little more but they are not in bed with each other.

we're all behind you here, buddy. you were scammed from the start. she married you for the green card, and does not care about you one little bit. you were just a ladder for her to climb. get yourself out from under her feet, asap.

she does not want to be seen with you? not any kind of love i've heard of. how about returning it in kind.

she wants a car in her name? she has no intention of going back to china. it is a hell hole compared to USA, no matter how good she seemed to have it there. a 30 year old woman unmarried in china has NO future, at all. at 30 she is totally un-marriageable in china, but just coming into her own, in USA. going back to china for her, once married to a lao wai, she would be untouchable, and die a lonely old maid.

she attacks you to set you up for VAWA? total nut-bag and not safe for you to be around. get the restraining order and refuse to have any kind of contact with her, at all. nothing in person. noting on the phone, nothing. she has betrayed you. give her nothing.

she is in jail on a felony count? good for her. you need to let her rot in her own designs. you owe her nothing but to tell the truth when asked to give testimony at her hearing and trial.

let's face it. she has no respect for you, and has written you off as a bad investment. you need to be as ruthless as she is in order to protect yourself, and trust me, chinese women don't know what mercy is. they are in the deal for themselves, from day 1.

If'n you want to deflate their sales process, tell a bailbondsman that she's a green card holder, obtaining one from a spousal visa, and nothing more than that.
