VSC Not alowing for service request

My NOA1 is April 5 and I called VSC to do a service request since I am over 5 month processing time but they refused to do it there reason for it was they are processing march 19 for CR1 - I130 cases and told me to wait another 1 to 1.5 month .

This is just unacceptable when I see CSC cases from June are getting approved.

Now are they supposed to accept service request after 5 month past due?

This weekend I am also going to write a strong letter to my Senator I know it might or might not help me but I will not seat on sideline and watch my case drag for months and months.

Totally unfair for VSC Folks to be given such harsh treatment.

My understanding was you're not eligible unless your NOA1 date is before their published "processing date" even if it's been more than 5 months. Ask them for the date they're currently working on. For example, VSC for K1 visas supposedly is working on 3/3 right now. So they wouldn't take a request unless the date is before 3/3. Even though if your date is 4/7 you are currently at 5 months.

But on the other hand, I just saw somebody post that they put one in and they are at 5 months.

Maybe it depends who answers the phone. Seems a lot of things do! :angry:

VSC is working on K-1 Visas applied on 3/3? How come they keep telling me 2/6? I just called by the way.... I-129F form.

I'm sure you have better information than I do. I got that date off the timelines page here on VJ. I guess that's not the official date. 2/6 sounds more in line with the fact that there are a lot of February petitions outstanding.

So will they take a service request for a petition dated after that, if it's over 5 months?

I saw an April filer (K1) post that they put in a service request. To be honest, I don't really think that's right when there are a bunch of Feb K1 filers & practically the whole month of March undone for K1. It seems like trying to push your way ahead in the line. I thought the purpose of the service request was to track down petitions that had gone beyond the normal processing time. April hasn't even been touched yet and shouldn't be until Feb & March are significantly handled. JMO.

No. I agree with you. I was just surprised thinking that you called VSC to get the March 3rd date.

So my NOA1 date is March 28th. I called because it has been past 5 months. I think anyone would try to give them a call. However, when I ask them to open up a service request, they say they cannot because they are currently working on applications with a 2/6 date. Ok. Fine. I'm just confused because petitioners who have applied in March are getting their NOA2's. You would think they'd update that date but....guess not. I dunno. Am I confused for no reason? I also see that people in March are getting approvals - however remember they don't go 100% in order. Those people are the lucky front runners. And to be fair, they should be attended to first. So I actually agree with them not doing a service request for a petition past their "official" date, and 2/6 is probably correct.

It's not the date of the newest petition they've looked at. It supposed to be the date that they think they've already looked at everybody from before that. So if they say that date, and you've heard nothing, there's a problem.

Clearly there's not a problem if I haven't heard anything - they just haven't gotten to me yet. I'm not one of the lucky first people in March. But I'm not concerned they've lost my petition or something, not at this point. There are too many people ahead of me to be worried about that.

What's delaying me? A problem of some kind that needs to be looked into - that is, a service request? Nah. They're just behind.

Now, for someone with an NOA of 2/6, if they haven't heard anything, yeah they should be getting concerned. That's what the service request is for. When everybody else in your date is done, and you still haven't heard anything and might be lost somewhere.

Yesterday i contacted my Congressman , a immigration staff member contacted me and they took all my info & ID and i signed a form .

next week if this congressman dont help me ill contact senator i am not going to seat idle ,

The whole process is a big fail I just won’t accept that CSC is finishing cases in less than 100 days while VSC cases are taking over 150 days actually even if I do get approved I’ll ask an explanation from senator and congressman what they have done to stop this unfair practice.

Update ---

Today i called USCIS and requested for Service Request, Tier 1 support was clueless no help and was not even sure what EAC stands for i guided him how to do a service request on phone he came back with same generic response sir you are still in normal processing time , i told him you are wrong 5 months is the processing time period , i refuse to accept it and requested to speak to Tier 2 i was greeted by a nice Immigration officer Lady , my first line to her was litsen i have my congressman working on this file and i have submitted all my docs to him now just tell me first thing what dates you are processing she put me on hold for 5 min then came back asked for more details like my name , address , etc first time some one requested this from me then again put me on hold and came back and told me since i am not happy with there service and i have contacted my Congresman she will file a service request for me and i should here before Sep 29.

And just to make sure she is not playing with me i noted her name , and ref number for this conversation and also requested a email copy of service request (you can also request a physical copy)

I also asked her what dates they are working on she told me they are working on my date itself April 5 .

The USCIS website says VSC is currently working on February 27, 2012 applications. I hope that changes soon so you can send in a service request. A baby needs his daddy! I keep looking at ur timeline to see if ur approve and every time I don't see it I feel horrible. I hope u get an approve next week.

hey mumbai- congrats for not laying idle. please update and let us know if u hear anything by the 29th. i am hopeful that you will. I'm so glad u got through to someone. when i hit 5 months i will be calling as much as i can as well.. i refuse to lay down and play dead!
