"Cindy" is a LPR. Cindy's daughter (age 11) is in the U.S. on a B-2 visa. Cindy wants to adjust her daughter's status while in America. I know that there is no biometrics cost for her. Is the filing fee $985 or $635? Based on what I read, it is $985 but I just want to verify.

It's only $635 when they are applying with a parent.

Was an I-130 filed for Cindy's daughter prior to May 2010? Unless I am mistaken, Cindy's daughter falls under the F2A Family, 2nd Preference category (unmarried sons and daughters of LPRs, under 21 years old) and the cut-off date in the current visa bulletin for F2A is 8th May 2010. She's not eligible to file I-485 until her priority date becomes current.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014

Cindy cannot file AOS until her daughters priority date is current or when she become a USC..

05/12/14- NOA1 Receipt date
07/01/14- Biometrics Appt

09/08/14- RFE response received by USCIS

09/22/14- 10yrs GC Approved!!
