Detailed step for Adjustment of Status

Timeline

So after getting married and saving money, we're now finally ready to adjust status! But I have NO idea how this process goes... We have printed the following forms, please tell me if I'm missing anything or if I have extra ones...

- Form I-485: Adjustment of Status form

- Form I-864: Affidavit of Support

- Form G-325A: Biographic Information

- Form I-765: Employment Authorization

- Form I-131: Application for Travel Document

- Form G-1145: Notification of Acceptance

1. Do we have to file the I-693: Report of medical examination and vaccination record??

2. So we mail all these documents and we should receive a NOA1 and then........................? [When is the interview? biometrics? etc?]

3. Is the total fee for all those $1070? in one check?

4. What other details am I forgetting?

5. Chances of getting denied?

6. Time frame of everything?

Second, read the instructions for EACH form carefully, they are available on the USCIS website... You will know how to complete the form and which documents to include.

For each form, you have instructions. Read them and that you will be 90% prepared. If you don't, then you will think you're lost and come to ask questions here that have been answered a million times (purposely because people don't red the instructions while most of the answers are there). :)

Total fee is $1070 for AOS, EAD and AP fees will be waived as you will be filing then with AOS.

The medical part is a little tricky, do you have a copy of your vaccination record (DS-3025) from your K-1 medical? If yes, which case the doctor ticked at the bottom?

After you mail everything (to the Chicago lockbox, read the I-485 instructions), you will receive 3 NOAs. Then you should have your biometrics appointment in roughly a month after that. Then your case is either forwarded to CSC and it will probably take months of waiting and maybe no interview, or your case will be sent to your local USCIS office where you and your spouse will have an interview.

If you follow the instructions and do all the job carefully, your case should be approved. AOS from K-1 is usually approved unless there's some red flags in your relationship/you don't follow the instructions.

Total fees in one check is 1070 yes... that's just for the AOS and biometrics

The EAD and AP fees will be waived if you file it along with the AOS or if you decide to file it at a later date, make sure you have a copy of NOA1 or NOA2 from AOS application so you don't have to pay for those applications. (EAD/AP)

2. NOA1 and Biometrics appointment letters are mailed out approximately the same time (I actually received my biometrics appointment notice before my NOAs for 485, 130 and 131)

3. $420 for I-130. $1070 for I-485, 765 and 131.

5. If they have reason to suspect that your marriage is for immigration benefits, you may be denied. Otherwise, worry not..

6. VJ has timeline averages, but expect 5-6 months. It makes anything happening sooner a much greater feeling.

07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

OP is adjusting from a K-1 visa so your answers to 1. and 3. are kind of wrong.

1. K-1 holders had a medical done in their home country prior to come to the US. If the vaccination requirements were met at the time of the K-1 medical, there's no need to go see a civil surgeon in the US, and so, no need to have the I-693 filed (but it's good to include a copy of the vaccination record filed by the doctor during the K-1 medical). It's all written in the instructions of the form. If some vaccines are missing, only part I and the vaccination page of the I-693 need to be filled (after the missing vaccines are done). No need to redo a whole medical and so to have the I-693 filed completely.

3. No I-130 petition for K-1 holder adjusting status. Another petition (I-129F) was done previously for K-1. As already said, total fee is $1070 if OP choose to file for AOS only, AOS+EAD/AP, or AOS+EAD+AP.

6. It can be 2 months, as it can be a year.

OP is adjusting from a K-1 visa so your answers to 1. and 3. are kind of wrong.

I only didn't notice it was from K-1 :) otherwise I definitely would not have said 1 and 3 the way I did.
