SO I'm thankful to say that my I130 has been approved, on 9-5-12. :) Now what is the next step? I contacted NVC to check if they had my case or my status. Yes, I know its only been one day, but still was hopeful and contacted them... They have not recieved my case and told me to wait 15 days after the approval for it to be transferred.....

Will the case me transferred to NVC within 15 days, or should I continue to call them?

What are the documents that I must prepare to submit, so the NVC process can we completed ASAP?

We do have a lawyer however that lawyer is in the same country as my spouse, I would rather be the choice agent, is this wise?

(FYI- the lawyer did make a few minor mistakes, actually a mistake that took the 1130 process longer then intented, I was the one that had to fix those mistakes)

Maybe I'm being paranoid, but their is no one that wants my spouse and me to finally reunite. The lawyer has been paid, however, he has other cases as well and whats the gurantee our case will be top priority? None, so should I be the choice agent/my spous, or the lawer?

You can do this entire process yourself :yes: No lawyer NEEDED!! :no:

Leave your lawyer as Agent, that will save you some time in NVC as you can pay AOS and IV fee together and there is no need to wait and send for DS-2030. Just be on top of your case and keep lawyer engaged. I also did same thing.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

WOW COMFORTING TO KNOW THAT YOU HAVE GONE THROUGH THIS STAGE, SO ALL THE ADVICE THAT YOU GIVE IS WONDERFUL!!! :)

THanks-helps but is confusing, you and another person from this thread recomended the complete oppisite decisions. Both of you guys have dealt or are dealing with the indian embassy.....

I'll be patient and wait 15 days...We already paid for a lawyer in India, earlier this year. HOwever, we (well me, Taal) had to constatly call him and make sure he was doing what he had to earlier in this process...The 1-130 process was prolonged because of his mistakes, and I fixed them... Let me remind you if I had been in India- Chandigar, he would have gotten a mouth full of my opionions and reactions.... He had gotten paid, so hedoesn't rally have to worry about fees or pleasing us. I never dealt with anyone in India...Tricky....My husband wasnt as concerned as I was. He lives in India and finds this as typical behavior... Anyways.....NOt to stray off topic, since all of my documents will be prepared here my tax returns, affidavit of support, blah, blah, blah... Should I just ignore the lawyer and do it myself? Yes you answered this question, however now that I have let you in on my experiences, maybe a recomendation can be made....

Sorry for Chiming in AGAIN!! :blush: and i know that we are not going through the same embassy, however it is still the SAME process. You stated that you have fixed his mistakes. (Your Lawyer) which you have already paid. I mean you said it yourself that you will be completing all of the paperwork yourself. Again i am just providing you my opinion :dance: and i think that as long as you can read the guides and the Threads you can actually manage this yourself without the lawyer.. :devil:

Leave your lawyer as Agent, that will save you some time in NVC as you can pay AOS and IV fee together and there is no need to wait and send for DS-2030. Just be on top of your case and keep lawyer engaged. I also did same thing.

EXCUSE ME FOR SAYING THIS------mY LAWYER IS AN IMBOSOL!!!!!

Its like dealing with a child, no sorry even children are better well behaved...

I have been to India twice in my life for my engagment 20 days and wedding 4 months....I just find it difficult to adhere to someone that has a difficult time to complete his job and fulfill his contract as a lawyer.....

I know I sound harsh and mean, however I have been on this journey for the past two years...FIrst applying for fiance visa and having it denied last year becasue lack of evidence of our realtionship....Getting your dreams ripped out of your hands and your special day transferred to a country you have no family and friends in did not help....My parents were the only ones that were allowed to attend... I know I'm holding a lot of resentment inside me, however I want this process to be done and over with so I can finally start my life and having a function here with my loved ones and with my traditions.....

I decided to go to India in November, and stay there for his interview and my cousions wedding....So it can be 4-6 months...I'm not risking anything anymore. I want this journey to end...And finally not puTtING my life on hold.....Its not fun or fair when you have to give up everything....

Anyways now that you know a little about my story would you still recomend the lawyer being the agent?

Sorry for Chiming in AGAIN!! :blush: and i know that we are not going through the same embassy, however it is still the SAME process. You stated that you have fixed his mistakes. (Your Lawyer) which you have already paid. I mean you said it yourself that you will be completing all of the paperwork yourself. Again i am just providing you my opinion :dance: and i think that as long as you can read the guides and the Threads you can actually manage this yourself without the lawyer.. :devil:

If you recall on my first response to you I sent you a ink. On that link there is an email template for the DS-3032 (choice of agent) you need to send that to NVC from your husbands email address making you the agent! You really needed to do is ASAP so it will give you a couple of days. That is exactly where I am at right now just waiting for my AOS and IV to get invoiced so I can pay the fees and mail out my packets!

So we decided to get married.. So, I totally understand what you mean. With all that being said, you should go ahead and have NVC done by this month if all goes well! And have an interview date for November December! :thumbs:

I will start preparing my paperwork, so when the I get the nvc number I will be able to submit the paperwork... As soon as this step is done and over with... I have the luxury of going to India and stay with my spouse... So looking forward to seeing him, minus the India part.... I don't want to risk him bombing his interview, so I will be there with him. Not taking anymore risks... :) appreciate your support and all the valuable information you have given me.

Pgupta- SInce you've gone through the nvc process I have a quick question......Okay I have yet not recieved my NVC number, and in INdia the police clearence certificate is needed for the nvc paperwork, so would you recomend me having my husband take care of it now? INdia, does take a while, the last time he got a police clearance it took him a month.... So did your wife and son wait? wAT DO YOU RECOMEND?
