Forgot to submit passport Copy

Hello everyone. My husband applied for his work permit two weeks ago. They cashed the check last Thursday but I realized we forgot to include a copy of his passport along with the application. He is currently in removal proceedings and we are fighting to keep him here. We finally got his court date and our lawyer said it was work permit time. We have our I1-30 approved and everything. Will they send us an RFE for his a copy of his passport. Been hearing a lot of different things even from my lawyer. They said there have been many cases where they dont ask for it since is so obviously in the system already. He told me not worry since they will just ask for it if they need it. I just don't want his application to be delayed for a small mistake such as this. Help!

Did you submit an I-765 for his EAD? I guess I'm a little confused because you normally wouldn't have to do that if you have an approved I-130. Obviously there is a little more to your case than usual.

On page 6 of the instructions for the I-765 there is a list of required documents http://www.uscis.gov/files/form/i-765instr.pdf

An identity document is one of them. I would expect an RFE if you filed an I-765 without it.

September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If they don't have a copy of his passport, they will definitely issue a RFE. If the application for the work permit is based on a pending application where they already have a copy of his passport (ie. pending I-485), then they may not request it, but there is really no way to know for sure.
