Just a quick question. I have looked at the info here on VJ and some of it is conflicting and from older posts as well. The instructions don't ask for some of this info either so I'm just trying to clarify and avoid and RFE.

Supporting docs to send with the I-131 when filing along with the I-485 (for AOS from K-1 visa. The most popular answers were:

1)2 passport photos

2)Copy of K-1 Visa

3)Photocopy of passport biographical details page

4)Photocopy of I-94 Arrival/Departure record (front and back)

5)Copy of Marriage Certificate dated September 15, 2012

Do I also need to include:

1)Copy of birth certificate

2)Copy of entry stamp from passport

For the I-765 is it necessary to include a copy of the marriage certificate?

Also, for the I-485 my hubby-to-be wants to include additional proof of relationship info but it is not asked for in the instuctions. Will it cause a problem if additional info is included?

Ok so I guess theres a bit more here than indicated in the title. Sorry about that.

Thanks so much in advance. :)

Hi there,

I would include the 1)Copy of birth certificate 2)Copy of entry stamp from passport (I actually think this is required as we included this but we filed I485, I130, I131, and I765 together) with your initial 1 - 5 but I would not send the additional proof of relationship. The packet ends up so big I would just hold on and not confuse them. You will most likely do an interview anyways which is where you will present that data. Just my thought!

AOS:

5/29/2012: Married
6/29/2012: Sent AOS Package (I485, I130, I131, I765)
7/02/2012: *Date Received Shown on NOA for I485, I130, I131, I765
7/13/2012: Text/Email NOA Received
7/16/2012: Hard Copy NOA Received
8/07/2012: Biometrics Appointment
8/27/2012: I131 and I765 (AP and EAD) APPROVED - 59 Days
9/05/2012: EAD Received
9/26/2012: Interview (I485 and I130)
9/26/2012: Conditional Green Card APPROVED - 89 Days
10/8/2012: Green Card Received

ROC:

9/4/2014: Sent ROC Package (I751)

Thanks for the help. I agree about waiting on the additional proof of relationship and saw posts to that effect here before but thought I would put it out there anyway. :)

I see you are in Denver area and from England too! Howdy neighbor!

heeeeeyyyyy!!!! that is so strange that yours is being processed through the California center! is there a reason you are not filing the I765 (work authorization) with your packet? it's cheaper to do it this way (i actually do not think it costs anything when you file it with he I485) and it allows him to work sooner! but i also see he has k-1 visa so not sure if that allows him to work so nevermind. either way, congratulations!

Actually we are filing the I-765 too I just didn't have a question on it at that moment.

The CA service center is where we went through for our K-1, it might have changed for the AOS. Im not sure. So confused about everything just trying to keep my head above water. :)

That's all I find required and all I sent. This is an I-131 application only. It has it's own requirements and not to be mixed with the I-485 requirements

You will send the whole package (with I-485, I-131 and I-765 as 3 separate applications but in the same packet) to the Chicago lockbox. It will then be routed to the National Benefit Center in Missouri. From there, your case may either be sent to your USCIS local office, or to CSC for "faster processing" (what they say...).

I-131 and I-765 should be approved in 2-3 months, and the I-485, you'll just have to wait and see! Can be 2 months, as it can be a year (but at least you'll have the temporary right to work and travel).

I definately understand reading the instructions but have to admit that I don't trust them completely. I swear I scoured over the I-485 instructions and didn't see any request for the marriage certificate to be sent in but surely they would want that right? For AOS from K-1?

I also want to say thanks to you cuz we have relied on your posts so much of the time to answer questions already through out the whole process.

ALWAYS trust and follow the USCIS instructions. You are dealing with them so if you don't trust their instructions, then who are you going to trust to complete your paperwork?

BTW, they explicitly ask for a marriage certificate in the I-485 instructions.

Page 4. Item 12 Evidence of Eligibility

"B. Based on admission as the K-1 fiancé(e) of a U. S. citizen and subsequent marriage to that citizen

Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate, and your Form 1-94, Arrival/Departure Document."
