I recently sent in my I-129F. I am wondering if I need my fiancee marriage certificate even though she is divorced last year. The only thing I have from her is police certificate, her divorce decree, and birth certificate, but the not the original birth certificate. Please, need some good advice...especially from someone who have thai fiancee.

Hi...I didn't need my previous marriage certificate until my interview at the Embassy....the same applied to the originals of birth certificates etc.

I must admit that I am from the UK and not Thai, so maybe someone else can confirm what I have stated.

Hello and welcome to the forum,

The I-129f requires that both you and your fiancee are legally able to marry. If your fiancee was previously married, you must submit the divorce certificate with the I-129f application.

The marriage certificate and her birth certificate is not required.

At least not at this time.

I disagree, but i also may be wrong, reading the I-129F instructions it says that you need it.

"If either you or your ficance were married before, give copies of documments showing that each prior marriage was legally terminated." page 2 number 5 D of the I-129F

Dont worry it may go thru but just incase i would get a copy and have it certified translated standing by incase you get a RFE.

Billy....I didn't quite understand your question about the birth certificate....maybe I wasn't clear in my reply either. What I had to show at the Embassy interview was the originals of all the documents that supported our I-129F such as birth certificate, divorce decree, police cert. etc.

From what I have read, and to my understanding, there is never a time in the entire process you need a marriage certificate, until it is the one you and your fiancee get after you are married! For previous marriages, only divorce certificates or decrees are required. I hope you sent in a Certified English Translation of her Divorce Certificate, otherwise you WILL get a RFE.

As for her Birth Certificate, if it is not the original, she will need her Thai ID card and Tabien Ban (House Registration) when she goes for her interview. Her Birth Certificate and the Police Certificates are not required until her interview at the Embassy. Why did you submit them with your I-129F? They are only valid for 6 months from the time of issue, so you better hope her interview is within 6 months, or she will have to get new Police Certificates.

If you want more information, I suggest you read the SAWASEE2 and original SAWASDEE threads. There is a lot of good information in both threads for people with Thai fiance(e)s.

thank you for your reply..it's been a big help. well..I just read instruction on I-129F form which required police clearance...so I thought I would submit the police certificate...I hope it won't be a problem with my petition. I lose alot sleep over this...I am missing my baby very much...stayed for 21 days in thailand, now lonely thinking about her, and our fun time in thailand....such a wonderful feeling...

Since you've already submitted the application, no need to worry and lose sleep. If USCIS has any problems with your documents, you will receive an RFE. You may want to get a headstart on the forms your fiancee will need for the Embassy interview.

I think you may find that things work a bit different in Thailand than in the UK. Not so much because the US consulates in the two countries have different ideas about things, although they may, but because the way things are done by the governments of the two countries can be different.

Does your fiancee have her previous marriage certificate? My wife, and her ex-husband, had to surrender their marriagecertificates to the Amphur when they divorced, and she had to surrender her divorce certificate to the amphur when we married. (We married in Thailand and she came to the USA as a K3). Fortunately, I was thinking ahead at the time and we made some photocopies of the divorce certificate before surrendering it. Unfortunately, a photocopy was not sufficient for the consulate and the consular officer wanted to see the no-longer-existant original. Caused a bit of delay...

Hi...I didn't need my previous marriage certificate until my interview at the Embassy....the same applied to the originals of birth certificates etc.

I must admit that I am from the UK and not Thai, so maybe someone else can confirm what I have stated.
