Hi,

I am filing I-130 for my wife. I am a U.S. Citizen. My wife is currently living with me in USA. Her I-94 is soon expired on 9/14 of this year. Since we got married on 8/8/12, we are trying to gather as much information to file for her stay with me. If we mailed in the material beyond 9/14 of her I94 expiration date. Would it count as illegal stay, or would she have an extra 180 days before it count as illegal stay?

Also, I am stuck on I-130 Part D Question#2 for my ex-wife. Back then, I know the place and result of my ex-wife was approved/granted. But I am unable to remember when was it filed. Can I leave the date blank, and just put the location and result (Will they reject?) Or should I use the extra paper to state I do not remember the date of that application date?

So far, my lawyer at that time who helped me and my ex-wife filed it; he is being not responsive and not cooperative to help me find out the date of the application for my ex-wife. He said it was long time ago and he does not have the record of that notice of action on file. But I have my check book record booklet that's showing the check numbers payable to that lawyer and to US Immigration Services with check amounts. Can I include a photo copy of the booklet indicated those check# and amount? Can I include about that lawyer on the extra paper to let the reviewers know that I tried to find out but nothing help from that lawyer?

Right now, me and my wife are stuck on that question and everything is ready and handy to mail out. Suggestions are welcome and answers are much appreciate.
