no.. probably there really is a prob with mail delivery.. uscis said they cant do anything yet about it... have to wait after 15 days if the letter is still not yet received that is then that they can tell me what to do.

It appears as if your letter is going to another address. You should have received it already. Ask what address they have on file for you. Mistakes happen. Sometimes they send mails to the wrong address. That's good grounds for appeal. In the past, I have received an email stating that I was RFE'ed. After waiting two weeks and not seeing a letter, I called and spoke to a tier 2 who noticed that they were sending someone else's information to my email and phone. It may be the case as you have not been receiving mails. Check it out.

I have received 4 pieces of mail from USCIS since I was touched on August 30. The mail got to me three days after the update on the website. check the case status and compare the MSC# to see if they are giving you the right information as well.

No, but the online status would have indicated that a RFE was sent. Normally if all goes well after biometrics, the next thing you get in the mail is the EAD card. It's pointless to speculate too much before the letter comes. For now I would start checking local attorney's for references.

If a denial is related directly to biometrics (usually it's for missing biometrics), it usually comes 30 days after the biometrics date.

Just to be sure, you did get married within 90 days of entry, right?

after 5 mos.. we gonna do everything we can.. we talked to a lawyer and he said there's always a way for approval on a previously denied case so long as u dont have any criminal case. so thinking about my husband moving to my country is not an option. im gonna stay here and file again.

it has been 9 days and i havent received the letter yet. my mom tried to send me a mail 5 days ago who also resides here in the US and would usually take 2 days when she sends me a mail. until now i still havent received her mail.

the update on my website changed only once. from the initial review(the time they received my application) to decision which is denied. i hope the update was wrong. that im approved. :D

uscis said online status is not always updated.. waiting until the letter is received is the best that will tell u where u are in the process.

yes we got married within 90 days... actually a week after i arrived.

maybe when u called the uscis before to ask about ur lost letters, 15 days have already passed that's y u were able to get a help from an ISO. coz they are very strict with the policy.. they wouldnt give information and would tell u what to do unless 15 days have already passed and still the letter has not been received.

nope, sorry. Is possible to get an ISO, but you (or the one using the telephone)

must be adamant.

The CSRs are braindead, and it's their job to get you OFF the phone, giving useless information. Just because a CSR said something to you or your husband, is absolutely NO REASON (at this stage, with a denial pending) to believe a CSR.

How's it going, so far?

CSRs cannot see the same things an ISO can see, on the computer system, as ISOs have higher access.

I am sad you are having this much trouble about it, really.

Get an ISO, Monday. Sort this out. There's a hope that things can get redone without cost, but you must engage with an ISO, on Monday.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

OK..OK... So I am a veteran at this and I just read this topic and I have a few suggestions. This is just my opinion so just take it for what its worth with a grain of salt.

Since you do not have the denial letter in your hands and you dont know why you were denied... you need to wait for the letter.

Or view what the possibilities are on why this has happend... here is a list of what I think happend.

1. I-485 file was done incorrectly (you should have received and RFE)

2. I-485 or something probably something got lost in the mail ( did you do delivery / signature confirmation when you filed? ) Did USCIS receive your packet correctly and cashed your payment?

Biometrics letter got lost...

3. USCIS Error (I have had experience in USCIS giving a denial letter for missing an interview... We actually rescheduled the interview and they did not get that letter, but we have

proof that we resheduled it the interview. The lawyer fixed this problem and we have all the documentation that we sheduled for another interview, but the denial letter

says we did not show up for the interview. (so yea) So after a few months of waiting... USCIS sorted it all out and found out it was their mistake.. resheduled an interview and got approved.

4. None of the Above.

So... I strongly suggest that you try to get yourself an immigration specialist / lawyer who can help you with this case when you receive the denial letter. This is actually very difficult to do on your own. These things do happen in error or some files do go missing or lost therefore you need to find a way to appeal the denial. Thats what lawyers do best.. they know and have experience with this.

When we take the responsibility to file on our own and follow all the guides and tips in this forum. its not always 100%. Last year, I helped my brother to file for his AOS.. I knew what the steps were of the AOS was, but the problem was.. I was not the petitioner. It was my mom who petitioned for my brother. The wait was almost 20 years to get to this point. Althought I knew all the steps of AOS because I did a K1-AOS .. filing with no issues. I was not the petitioner and if something goes wrong.. Id rather have a lawyer who will be there to help. Its worth all the $$ as long as you get your papers fixed.

Let us know when you receive the letter and what it says... also if you could.. please update your timeline so we can get an idea of what is going on.

Lastly, you need to make sure you have all your paperwork organized and complete.. just in case you need to show any info to USCIS.

Hope you also made a full copy of the AOS packet that you sent...

is exceptionally rare that an AOS is denied, when adjusting from a k-1 visa.

do you have any sense of red flags about the paperwork that you sent off ?

and

did you get married within 90 days of arriving in the USA ?

when you call back into USCIS tomorrow, ask for and get an ISO , then ask the ISO:

1. do you have any returned mail pieces on me? (if so, go over the address again, ask for them to be remailed )

2. when was the denial letter sent out ? lets check the address again, just to be certain.

Good googly moogly OP, Please do as Darnell has repeatedly suggested to you over and over...since you have not received anything about a RFE or even an interview....you may never get the denial letter either and from the looks of things...time's awastin :bonk: #justsayin
