Timeline

I am engaged now, and need some pointers.

1. I have not seen my fiance within the last 2 years

2. I have a trip scheduled february 07.

3. The *informal* wedding is scheduled august 07

I cannot change those dates.

Is it possible for me to bring my wife home in august 07?

Could I start the paperwork now?

Comments or suggestions would be great!

07/??/00: Met Fiance

05/??/06: Rekindled with fiance

10/20/06: Proposed, with a yes!

12/23/06: Met fiance in person after over 6 years

12/24/06: Engagement party in Vietnam

01/01/07: Went back to America

01/03/07: I-129F Sent to CSC

01/08/07: NOA1

03/26/07: NOA2

04/04/07: NVC Receives case

04/13/07: HCM Consulate Receives physical file

04/24/07: HCM Sends Out Packet 3

05/03/07: Packet 3 Received

05/07/07: Packet 3 Sent

06/23/07: Packet 4 Received FROM honest neighbor BLOCKS away (sent to wrong address, actual receive date ???)

07/12/07: Interview Date!!! BLUE SLIP

08/31/07: Went in personally with sound advice from M.E. and got the PINK SLIP!!!

You can gather documents but you cannot file until you can meet the requirement of having met within the past two years, it is possiblethat you could bring her home in August but I would not BET on it to be safe.

In a word, Probably not.

If you haven't seen him/her within 2 years without extraordinary evidence of hardship, your petition will be denied.

You will have to wait until after February to apply, and then the chances of having NOA2, and your interview done before August are pretty slim.

Why are the dates non-negotiable?

Your petition will be denied if you have not satisfied the requirement of having met in person within the two years before your filing of the petition.

You should wait until you are there in Feb. to gather all of the necessary documents and file from there via Fed Ex or immediately upon returning home.

Depending on where you live in the US and at which service center you are required to file, depending on whether or not you receive RFEs, depending on whether or not you get held up in name checks or at the National Visa Center, depending on how long it takes to get an interview, you may or may not be finished by August, 2007 - impossible to know.

p.s. NOT recommended to use the word "wife" until you are legally married and finished with this process - otherwise it can trip you up down the road and make things much more confusing and difficult.

Hopefully other VJ'ers with fiance(e)'s from Viet will chime in but I think the timlines out of HCMC are pretty long. In a normal sequence of events August will be tight.

late august is the only time my brother can attend the church wedding we are having for her parents, but he official wedding will be done here. due to a lot of misleading characters in vietnam, the church will only perform the wedding if the papers are in order (I'm guessing visa approval).

Since you have not seen your fiance in the last 2 years you will have to wait to do your paperwork until you visit your fiance again to develop current evidence showing having met in the past 2 years.

I have read several posts where people filed the visa petition before meeting then having it rejected by the USCIS.

Look at the timelines for K-1 and K-3 and filter for Vietnam to get and idea about how long it takes, Feb-Aug is a short time to expect. I see several that were filed in Feb of this year getting interviews in Oct. Before the IMBRA there were cases filed in Jan getting interviewed in July.

You intend to have a ceremony-only type of thing in her home country.. and then the legal one once in the USA?

Edited to say: If you're planning on the official wedding in Vietnam, an I-129F isn't the form you need to be filing.

the ceremony only wedding will be in vietnam, but priests there will only allow if I have finished the paperwork(I'm guessing visa, but I will verify later). Legal official wedding will be in the United states.

Huh?

Sounds like you first need to find out what paperwork they are talking about. But you also need to be realistic - chances are slim to none that you'll be finished with visa in hand by August. It is highly recommended NOT to make any set plans until the visa is in the hand - flights, ceremonies, nada. You just never know what delays you may face.

Sounds like you first need to find out what paperwork they are talking about. But you also need to be realistic - chances are slim to none that you'll be finished with visa in hand by August. I assume he is talking about the "ceremony" in vietnam that he would call off because of his brother rather than the the US based event.

Nobody wants to give you a big downer but nobody wants to set you up for heartbreak. If you live in a state covered by VSC they are now turning petitions in about 30-45 days. The big unknown is what will be the situation in Feb when you file and then how long HCMC will take to schedule your interview. It is best to find some similiar members who are in process with vietnam and understand the timelines.
