10 year green card expired

Guys,

A friend of mine is having some trouble. I do not know how she got into US in the first place (yet) but her 10 year green card expired in february. To the best of my understanding of green cards if it is a 10 year one her card is expired not a status. If you agree what are her options now? Can she apply straight for citizenship or does she need to apply for another green card first? If so what form?

04/09/2008 I-130 sent to Chicago Lockbox

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

02/17/2009 welcome letter received

02/23/2009 GC received!!! yay!!!

04/10/2012 New prints required/done

04/14/2012 Received a welcome packet but still no certificate

04/17/2012 Certificate is here!!!!! Dated 04/16/2012 huh????

She must have a valid green card to go for citizenship. I am not sure the process for expired green cards of the 10 year type, I know the 2 year one is a mess if you miss it because of removing conditions.

This will not be over quickly. You will not enjoy this.

Your friend needs to file an I-90 and get a new green card. For simple cases (sounds like this case) the I-90 can be filed electronically on the USCIS website. The cost is $450, and includes a biometrics appointment for new photos and fingerprints.

You are correct that the status doesn't expire when the green card expires. Your friend is still a permanent resident, but without a valid green card they would have trouble proving it.

Hey guys!

Thanks a lot for the reply. I got some new details here. So my friend already applied for I-90 but the real problem is she needs to verify her employment eligibility. She has her valid DL but her SS card has the old wording on it since back many years ago "valid with DHS auth only". So, what are her options on proving work eligibility?

The only thing I found is this section in I9:

"If an employee is unable to present a required document (or documents), the employee must present an acceptable receipt in lieu of a document listed on the last page of this form. Receipts showing that a person has applied for an initial grant of employment authorization, or for renewal of employment authorization, are not acceptable. Employees must present receipts within three business days of the date employment begins and must present valid replacement documents within 90 days or other specified time".

Any other thoughts?
