so, getting all the stuff together, I had scanned everything into the laptop and saved it so I could print it out when we needed them. come to find out that daniel deleted that file without realizing what it was. I am seriously disappointed. I have NO idea what to do. I know on the interview letter it says 'unless otherwise submitted' for the Affidavit of Support form (I was the only one on it) and the I-693 says the same thing. What should I do? start filling them all out again? And when it says original and copy of each supporting document I submitted with the application, does that mean for everything? Here is what I sent off as I found my cover page:

1. Payment by check (I can print off the check I do believe off my bank website)

2. Form I-485 (lost in delete)

3. copy of non us citizens passport

4. copy of non us citizen k1 visa

5. copy of noa2 approval form i29f

6. copy of non us citizen valid i-94 (front and back)

7. copy of intending immigrants birth certificate

8. copy of marriage certificate

9. g-325a (lost in delete)

10. two passport photos

11. copy of ds-3025

12. i-864 (lost in delete) and supporting documentation, I can print off my bank statements from what i sent before as i know when we sent the application and my savings account information

13. i-765 (lost in delete)

most of that is easy for me to do, but i honestly don't know what to do about everything else i lost. anything anyone can tell me? i'm upset and he knows it, i dont want to screw this up.

You should be able to get new copies of the majority of that. You can bring a new I-864 if you want. You will not need to give it to them in most cases but you'll have it if they lost it - you can bring the most recent pay stubs etc to go with it. You don't need to bring a copy of the I-485 or any of that. It is really the evidence and required supporting documents you want to make sure to have copies of.

I would not worry as they have all that and if they didn't they would have already asked for it in an RFE. I would recommend you take along a certified copy of the marriage certificate and another copy for them to keep. That is the only thing she looked at was the certified copy and the copy I brought in with me. She made copies of our IDs--my DL and my wife's EAD/AP and passport. She kept the I-94. You can recreate the forms if you want, but I would work on filling out the ROC and N-400 instead. This is one reason I have several copies floating around on different computers.

Has it been comptely deleted or is it sitting in the recycle bin where you can do a restore?

Try doing a system restore to the day before the files were deleted and that may bring them back to their original place. If that doesn't work, you can search for recover file software or undelete files software on google and yahoo. Those software usually will recover all your files, even if you deleted them and empty the recycler bin.

he definitely put them in the recycle bin and then cleared that out. if you think its alright i will just make copies of everything else, i've never tried the file software stuff though.

They want to see originals of your documents like marriage certificate, USC's birth certificate or how he proved citizenship, etc. if you sent photocopies in the packet. You don't need to worry about providing the forms again.

First remember the letter is a very generic form letter not written with just you or even K1s in mind. It says 'unless otherwise submitted' which means if you havent already provided those things, bring them. You've submitted your list of 13 things so you only bring anything you feel needed that is in addition to those 13 items. Maybe you have more marriage proof like a joint bank account or some wedding photos to show that you didn't already provide. The original copy of you marriage certificate would be good so they can see the real deal as well as other originals like I mentioned before. They have your forms or you wouldn't be this far in the process. They dont need them again. If you have more recent pay slips, you can bring those but likely don't need anymore if you provided some.

I can't say how your interview will go, but ours was in Detroit, as well, and was a real breeze. I was making photocopies right there in Detroit just an hour before the interview, worried I didn't have my two extra copies; Then I called the courthouse where we got married three hours drive across the state, about the fact I didn't have a certified copy of our marriage certificate, even though it was now too late for that anyway.

When we got in the interview, we were interviewed for about 10 minutes total. She said she had everything, and was there anything we wanted to add, which really wasn't much, and she even reassured us she had everything, even she had only a color copy of our marriage certificate that I originally submitted and she never asked for a certified copy, and we were told we'd get his green card in 7 to 10 days. I was quite shocked. But just do what you feel you have to do and can do now, when you have time, so you feel confident and just in case.

If he just deleted the files the standard way, odds are that you can still recover them, or some of them, unless they've been overwritten. If you want to to it that way, I'll explain how. Otherwise, the evidence should be fairly easy to get since those are original documents (passport, visa, marriage certificate, i-94 - you still have those items). as Nich-nick said, originals are what you're meant to bring to the interview.

K1 process, October 2010 > POE, July 2011

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

On the subject of original documents, there is always this big warning that originals may be asked for at any time when photocopies are submitted. However, we went all the way through K1, AOS, Removing Conditions, and my husband became a citizen in May. We are done with USCIS forever, yet they have never laid eyes on my (the USC) originals of birth certificate, marriage certificate, passport, the death certificate ending my previous marriage, tax transcripts, pay slips, or bank statements. So they are not always as strict as they appear. My husband did show his birth certificate and police certificate at the interview in London.

But we dutifully haul out those documents just in case. Sometimes they don't bother to ask to see them.
