Hello everyone! I am back with a question, need help! We sent the papers for AOS and we received a request for initial evidence. They say that based on the dolcuments that we submitted we dont meet the income... The taxes dont show hat but my usband got a new job, a second one starting april this year so that does not appear on taxes but we submitted other papers that shows that... Anyhow we will send again those papers but this time we want to send a letter to explain all. Does anyone know how we should write this letter? Help me please! Thank you in advance!

ds230,i864ez,aos and iv receipt,documents(6 last pay stubs,job letter,beneficiary's birth certificate(certified and legalized),2 2x2 photos,police report(certified),w2 and transcripts from 2009-2011,copy of beneficiary passport.8/23/12

checklist received from NVC on 8/30/12- missing petioner's documents(marriage certificate,birth certificate,2011 transcript).

Is he self-employed or an employee? This makes a difference. If you are self-employed they go by line 22 of the most recent 1040 tax form. If he is an employee, he could send letters from his employers stating his position and salary and most recent pay stubs from both jobs to show he makes the 125% requirement for his household size.

What did you send in initially?

Thank you guys for your replies but you did not answer about how the letter should look like lol. So i make it clear: he is self employed coz he is a DJ but in same time he is employee coz he has since april this year a full time job. We did sent the taxes, the letter from the place he works stating his position and salary and most recent pay stubs... we sent paystubs from the company he is Djing for too. We sent them all this but somehow the USCIS guys couldnt see that clear lol. So now we will sent again all those papers but also a letter to explain black on white all so they understand. My issue is how should i write this letter, please if someone can send me a link with an exemple or if someone was in same situation or me or can sugest me something, please help! Thank you very much!

Perhaps list each piece of evidence you are including with your RFE as you explain his different jobs and incomes. List that he is self-employed as a DJ and makes $X a year, then list that you have included his most recent tax transcript to back that up. Then explain about him having a second job since April that he makes $X amount a year at and list the letter from his employer and the most recent pay stubs from that job. Just try to make it as clear as you can that he has 2 separate jobs and makes enough to cover the 125% requirement. Resend all the documents that prove his income is enough, even if you sent some of them before. Just update with the latest pay stubs.

Perhaps list each piece of evidence you are including with your RFE as you explain his different jobs and incomes. List that he is self-employed as a DJ and makes $X a year, then list that you have included his most recent tax transcript to back that up.
