So for myself and 2 kids is it 3 x I-130?

Does the petitioner (my spouse) file a I-130 for each of us separately? I know on the form it asks for the name of children but how exactly does this work? Can someone please clarify this for me? I thought I had it figured out but it seems I do not.

USCIS - 40 DAYS
2012-10-30: FedEx delivered I-130 to Chicago Lockbox Mail Room
2012-11-01: NOA1 by email - MSC
2012-11-02: $420 (x3) debited from our account
2012-11-05: NOA1 hard copies received, Priority Date 2012-10-30
2012-12-11: NOA2

NVC - 26 DAYS
2013-01-02: Rec'd case#, IIN, BIN & OPTIN emails for EP sent

Your spouse will file a separate I-130 for each of you.

You would attach the documents listed in the instructions for the I-130 for step-children. Off the top of my head it's your marriage certificate, any divorce certificates for you and your spouse and long form birth certificates for the child the petition is for. I believe you would need to attach a G-1145 to each petition and a separate cheque for each.

We are getting ready to get the petitions for me and my teen together right now so we will have a similar timeline for our journeys. :)

So each application will need a photo of my spouse? And each will need a copy of divorce paperwork? And each will need a copy of HIS birth certificate along with the one for the person whose application it is? This is starting to sound messy. Do they all get sent in the same package? Does there only need to be one set of documents to go with the 3 I-130 or does each need its own set of supporting documents?

When I look at the instructions for the form the photo is only in the Husband/Wife section. http://www.uscis.gov/files/form/i-130instr.pdf

I was only going to put what was listed in para 8 of the instructions on my daughter's I-130

  • Marriage certificate of the stepparent to the child's natural parent showing that the marriage occured before the child's 18th birthday
  • Copies of documents showing any prior marriages were legally terminated
  • Copy of the stepchild's birth certificate (I have her long form already so that's what he's sending)

Because each petition is separate (& yet together), I would think that you would need the first two in the list on each and then just that child's BC attached to their petition.
