I have a friend who is entering the US with is girlfriend next month. He as a (10 yr) B-2 and she has an internet visa not exact;y sure what it is called but she bought it online she is from England.

My questions are:

1. Can they both apply for permission to work while already in the united states?

Do they need to do that while overseas?

2. If they apply while overseas, will a pending application hinder their ability to enter?

I have read information and instructions on some applications but it is very confusing any and all help much appreciated!

None of them has work visas. They both have the tourist visas only, so no working.

Since she's from UK, she can stay in the US for maximum 90 days (the UK has VWP with the US).

He can stay as long as the CBP officer will let him.

I'm not sure if they can change their status to H-2B. They can't change their visas while being in the US, since you can apply for a visa only from outside the US.

The US employer must apply for a work visa on behalf of of the worker. The worker does not apply and then goes looking for a job.

So, your friends must have US job offers with a US company willing to apply for work visas on their behalf. The US employe must get a Dept. of Labor certification that no US worker is available and that is why the employer needs a work visa to bring over a foreign worker. This is not a short process. It can take months to get the certification.

There is no way that your friends can visit, be granted work visas, and stays. It takes more than 6 months to grant a work visa and their visas will not permit them to be in the US for longer than 6 months.
