School SEVIS record terminated - AOS pending

My husband's F1 SEVIS record was terminated last week because he didn't enroll in fall semester. He wants to continue his schooling after he is a permanent resident. It just makes financial sense.

Interestingly, the day it was terminated is the same day that our interview date was scheduled. Do you think the two events could be related? Would USCIS check the system once the SEVIS was terminated and then have noticed that he has an AOS pending? Or is it just a coincidence?

don't worry about it too much..i am inthe same situation, tho i did send copy of my receipts to my Dso..my F1 status is currently invalid as AOS is pending. as long as you have a faithful marriage you will sail right.through.

adjusting from f1 visa:

So if you are doing the AOS and your F1 status is currently invalid, can you still study like before? Can you still work on campus (like before- if you did work)? Just wondering...

It doesn't matter if SEVIS is terminated because he is under a new period of authorized stay.

You can still study, the rates you are charged will vary by school. Working requires an EAD.

Hello! Thanks for your reply. What to you mean "rates you are charged will vary by school". What rates? Up until one is an F1 student you don't need EAD...is the EAD now needed because you are no longer an F1 student, but also not an LPR? Is that it?

Okay, maybe I'm putting my question wrong. So, yes, he didn't enroll for fall semester hence his SEVIS record got terminated. That is making sense. What I am trying to figure out that what happens when an F1 student files for AOS? I am not talking about the OP here, but asking the actual situation. When a F1 student files for AOS, it takes a while for the petition to go through and have it either denied or granted at the end. In the "meantime" while the student who filed AOS is "waiting" for the approval/denial, is this person still legal to register for school to take courses and continue their on-campus job that they have been holding? Or is that means that they cannot register for courses at all, as well as cannot work on campus at all either as they are in the process of adjusting their status? That is what I am wondering about. Anyone has any experience, or advice on this?

Yes, if AOS is pending, he/ she can continue classes. He can continue his on campus job if he is still in status

Rates will vary ie you may be charged international rates etc.

If you aren't in status you can't continue working until you receive your EAD (which you should apply for with AOS).

guys, i am in a similar situation. I am waiting on our car titles to be updated. its gonna take 3 weeks. since i was gonna submit the aos packet before school starts, i thought i would be ok , even if i dont enroll in any classes for this fall. but since its gonna take 3 weeks after school starts for me to have all the documents. Do you think I will be in Trouble , because i think I will be out of status by then? any help would be much appreciated.

You are deportable from the day after your I-94 expires to whenever USCIS receive your I-485 application. They are very hot on student overstays right now.

Could something happen between your SEVIS status being terminated and your AoS filing? Yes. Will it? No idea.
