After the long journey, two and a half years my dad got an immigrant visa (green card) to come to US. I am US citizen. Before entering US, he lost his visa sealed envelope ( yellow package, medical forms).

You would think either embassy or NVC would recover his papers but both agencies say they already have approved and don't have any papers. I have been contacting back and forth for 9 months now. USCIS didn't answer to my last question a month ago if I should start all over. Earlier they told me that I should contact NVC or embassy as my case is already approved. I don't even know if I can start all over. :blink:

the sealed packet contains his entire casefile, from I-130, I-864, ds-230, civil documents, medical stuff (maybe) /..

I think you need to speak with a vice-consul at the IV Unit where he was interviewed.

Do that, wade through the bullcrap 'other' workers, till you get a Vice-Consul,

then ask for 'what to do'.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

a us citizen can get through to 'americian citizen services' when it's open. Start there, ask for telephone appointment with a vice-consul attached to the IV Unit. Typically, a Vice-Consul at the IV Unit is 'the boss'. Typically.

Darnell is correct. They can't reconstruct the contents of that envelope because it contained his entire original case file. The consulates use the immigrant as a courier to carry that case file back to the US. The consulate may have copies of some of those documents, but I don't think the case file would be valid without the original documents. Obviously, get someone with authority to confirm that before you try to start over.

If it turns out that you must start over then close the current case first. Have your dad return to the embassy and explain what happened, and ask them to cancel his visa. You can then start with a new petition.

I have been contacting back and forth for 9 months now.

9 months? I guess your dad's visa has been expired now. As far as I know, immigrant visa has 6 months validity to enter in United States.

Please follow the advice as given by fellow VJ members.

well, here's the cool bit - I-130 petitions, once approved, don't expire.

So is possible to pick up again at NVC, IF a Supervisor at NVC will accept the SAFEFILE version of the I-130 that's 'in the network storage' already.

So, maybe you have a chance for 'half' of the process, starting at NVC when/if ..
