HELP!!!! for Advance Parole.. PLEASE!!!

Timeline

Is there anyone out there who can try to help me, I wanted to go home (Philippines) because my dad passed away 3 days ago. Unfortunately, my aos is still on process and I did not file for advance parole, thinking that I will not to travel right away. I made an appointment to infopass but it broke my heart when the available day of appointment is September 14 and the burial day of my papa is on the 10th. What shall I do? I am so down now. I wanna go home and see my dad for the last time. Can I just go to local uscis without any appointment letter? Will they let me in? How about the fees? Please help..:(

Nothing makes it impossible, it is just a very hard choice. You can leave and then wait for a CR1 process or you can not attend the funeral and continue the process. You may just show up at the office and see if they let you in but they may not and may not be able to help. Your father is gone, you must make the choice that makes the most sense for the living.

This will not be over quickly. You will not enjoy this.

I am sorry for your lost girl :( i know how hard you are going through right now, very stressful.

i do not have an answer all i can say is Condolence to you and your family... (F) (F) (F)

Be strong & your papa will understand your situation it is hard to leave here in USA & we don't have a choice but to follow their rules & paperwork, i hope there's a way for you to fly without any problem when you return.

I am sorry to hear of your loss.

Without filing an I-131 you cannot leave the US and return.

You would need to make an Infopass appointment, as you have tried to do, in order to make an emergency I-131 application. You would need to take a completed I-131 together with documentation of the emergency (a copy of the death certificate, a letter from the doctor, etc.) in order to do this.

They will not let you in the building without an appointment so it is bootless to turn up and hope.

I do not see any way in which you can return to the Philippines on your desired timescale without abandoning your AoS. Only you can say whether this is something you wish to pursue.

Try another USCIS office with shorter InfoPass wait times. You might be eligible for emergency advance parole (which can be issued same-day).

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

I am sorry for what you are going through.

If you decide to go home before your AOS is granted you can file for a CR-1 visa, spend the 7 months or so with your family and return to the US. I know this may not be the best option for you, but it is an option if you feel your family back home need you.
