Hi everyone,

I am not there yet but just reading ahead on details of I-864 and I-864 EZ forms for affidavit of suport. My company went belly up a few days ago, right in time, as a result I am unemployed at present. My usual income far exceeds the poverty limit numbers but I suspect my employment status affects the process now.

I am the sponsor and US citizen. Assuming that I-864 is due before I can find a job, does this mean the following?

--1> I won't be eligible to use I-864EZ form

--2> I will have to show assets at least three times the poverty line? Or is that not necessary because the last years tax return shows amount far exceeding the poverty limit?

I think I am confused where the 864 form asks for "My Individual annual Income is Currently:" do I put a $0.0 because I am unemployed or is it the last years income?

You need CURRENT income at/above the 125% for your household.

OR

Assets at 3X the 125% for your household

OR

A winning combination of the two.

I was unemployed when completing my I-864; a j-o-b is not a necessity. How's your investment portfolio look? Any real estate? Any passive income?

Your past income will show, as mine did, that you have at least two brainis to rub together and you're capable of earning at/above. They are simply a part of the equation, not the only piece.

You also appear to have time to land a 'whatever' job if you'd rather show employment.

I won't lecture you on the horrible rate of return you're getting on a savings account, but yes, if you can prove the value of your socks, you are set to go. :)

On a related note, if my next job requires a move (change of address) will that affect the processing time? Has anybody moved while this CR1 process is pending?

It might be difficult to prove the amount of money you have under your bed. It might be even more difficult to explain why you keep such a large amount of unrecorded cash. It might also be difficult to explain a sudden large deposit into your bank account especially when you are unemployed.

It might be difficult to prove the amount of money you have under your bed. It might be even more difficult to explain why you keep such a large amount of unrecorded cash. It might also be difficult to explain a sudden large deposit into your bank account especially when you are unemployed.

What I meant was, it is gathering dust in savings account in a bank and not earning in some stocks & bonds :) portfolio.

OP, deal with the moving issue when it comes. Instructions vary depending on where you're at in the flow.

So Mexuna, Does it mean that most of the liquid asset and little or no income would be ok?

What I mean is lets say a family of 4 (req is $25,000). sponsor and a family member togather makes $ 19,000/year and has asset (cash and stocks) of $40,000 would not have problem????

Also sponsor changed job six months ago but makes more than before, I sent my I-864 with everything including 3 years tax transcripts, bank letter and bank statements for six months, employer letter, broker's statement but I did not send pay stub as I don't get them. Will this be ok?? I am always worried as always. :lol::lol::lol:

Very quickly, it looks like your figures add up; I'll presume you checked the math before you sent it.

As for your evidence, I can't answer. Some of the reviewing officers can't seem to see what is in front of them. :blink:

I was also thinking about how I-864 is processed?

NVC takes 3-4 weeks to review I-864 then they send it to the embassy so should we assume that NVC thoroghly checked it and we shouldn't have problem at the embassy???

Also an officer check I 864 at the interview but he/she barely has 5-6 mins how carefully they check it?

One more thought, even though USCIS and DOS has set rules for reviewing I-864 and supporting documents but oficer at the embassy often does not seem to follow them.

heheh.. don't get too excited; I am getting quite old and confused. It looks like it would be easier for you to call me "Mo". :)

No, NVC makes sure you sent in the required evidence and that you are within the document's $$ guidelines.

The Consular Officer makes a determination on whether or not the financial picture is adequate.

Because it's their job, what they were trained to do, and they look at hundreds of these documents. If there is an issue with it, they give you an opportunity to fix it.

And, you don't know how much time they looked at it before your beneficiary steps up to the window.

hmm, I haven't heard stories like that. Are you sure? The main think I notice is the I-864s sent in for AOS are not evaluated very carefully at the intake point, delaying some people's EAD applications.
