They do not. They are in Canada on student visas.

She is US citizen and holds French Passport.

He is French.

My fiancé was born in the US and she is US citizen.

Yes both french passport holders.

We are also residing legally in canada, student visas.

But my fiancé hasnt lived in the US, ever, so she won't be able to show those tax reports you need for the CR1 ?

The possibility you are talking about looks interesting, we'll have to apply for a CR1 then ? But my fiancé hasnt lived in the US, ever, so she won't be able to show those tax reports you need for the CR1 ?

your french passport give you rights to stay for 90 days in the us as a tourist, if the us immigration received your K1, you gonna have to stay until a fiance visas is available for you, and with a fiance visas you have 90 days to get marry in the us to stay as a legal us resident. my advise for you is, if you decide to live in the us, better get married before you come to the us, and you'll be a us citizen husband, and with your 90 days visas tourist your french passport give you, you can before 90 days filling I-130 (Petition for Alien Relative) if you approved, you'll be a legal resident in the us.

Sounds like a good advice. But, my fiancée is not living in the US, she's with me in Canada and we are going to France for 2 months. To fill an I-130, does the US citizen has to be in the US or she can be out of the country and we get there at the same time ?

Yes a CR1... Then, because France does not have an USCIS presence, your petition reportedly goes into a queue that is called auto-expedite. Read this thread.. Good info

Not a good idea at all.....

OP, there is no easy way to immigrate without some inconvenience to the beneficiary. If it were, there wouldn't be a thousand people here on VJ complaining about the wait.

Just talk over with your fiance what you guys want to do and where you want to live permanently for awhile.

Good Luck with your decision.

OP, there is no easy way to immigrate without some inconvenience to the beneficiary. If it were, there wouldn't be a thousand people here on VJ complaining about the wait.

Just talk over with your fiance what you guys want to do and where you want to live permanently for awhile.

Ok, so we should get married, file for I-130 (wich will be quicker than K1 ?), ship to chicago and then wait 4-5 months in France ?
