K-3 and advance parole???

Timeline

i just got my K-3 visa last monday and then crossed the border yesterday.

while i was getting my I-94 and such, the border officer told me that i had to get advance parole in order to leave the country.

is this true?

i told him that i was under the impression that this was not the case for K-3 visa's.

he was like, "no, no, no...all visa's need advance parole."

i swear to god i read on the uscis website that K-3 visa holders do not need to apply for advance parole.

i am a bit confused.

i am beginning to wonder how much do border officers really know??

If your report of the CBP officer's instruction is accurate, the officer must have been a 'newbie'. (S)he was wrong on 2 points.

A K-3 Visa is a multi entry visa, no AP required. Border officer is miss-informed.

Can I travel and re-enter the U.S. on my K-3 or K-4 visa?

Aliens present in the United States in a K-3 or K-4 nonimmigrant visa status can travel outside of the United States and return using their K-3/K-4 visa. If they have filed for adjustment of status in the U.S. prior to departure from the U.S. , USCIS will not presume that the departure constitutes abandonment of an adjustment application.

From the U.S. Dept of State website:

"Can I travel and re-enter the U.S. on my K-3 or K-4 visa?

My guess is that often times , like with any profession, people we expect to have a clear understanding of the rules and regulations as well as current policy aren't always as up to speed as they could or should be, yet they choose to offer their " pearls of wisdom" as if they are true to fact. What this person likely forgot to remember is the AOS factor with the K-3. Just goes to show ya , we really need to be in charge of the information we gather and get verification of the facts,rather than taking a single ( in this case underinformed) person's word as gospel.

What is a concern is that this is the second report I have read of on this same issue at a Canadian border crossing. Same CBP officer perhaps, maybe not. Am curious as to whether someone reentering the US on a K-3 could be refused entry based on a CBP officers wrongful opinion that one needs AP.

I wonder if it would be beneficial to print the page from the Dept of State website outlining the policy. It may save a trip to secondary if you can show that?

Couldn't hurt.

I'm sure these officers have the best intent but they are human.

When we had to journey back up to Pittsburgh to 're-collect' the I-94, the Senior CBP officer was using Wes' entry as an opportunity to refresh K1 entry training with the two officers under his command that day.

Hello,

May be he thought that you have filed for the AOS but being on a K-3 status you can move out without the AP. The K-3 is good for 2 years to travel and work.

May be he thought that you have filed for the AOS but being on a K-3 status you can move out without the AP. The K-3 is good for 2 years to travel and work.

so can i travel to canada eventhough i have not applied to adjust my status?

i also want to work, so i am going to fill out the I-765.

can i do this right now?

or do i have to adjust my status and apply for work authorization at the same time?
