You can file taxes with an ITEN Number
It's an ITIN (Individual Taxpayer Identification Number) and you cannot file taxes with an ITIN that the IRS won't issue to a K1 or LPR. :no:

You will need it for other govt. benefits such as Driver liscense.
I never really considered a DL a government benefit. I had to take a couple of tests and pay a fee to get mine. Not sure how that works in states other than TN, OH, FL. Maybe other states provide a DL as a benefits to residents, the aforementioned three do not. :no:

Well if he dicks around until tax time her K-1 status will be expired and then she can get an ITIN.
Yeah, like that's less of a hassle than getting a SSN...

IRS do not have to issue a ITIN if a SSN is available to the person.... as she is a Permanant resident a SSN is available.... so if she applied for ITIN it could be refused and a SSN issued.... see IRS Publication 17 SSN & ITIN chapter 1 page 11 ITIN is available to non-resident aliens, others not eligible for SSN... USC and Permanat residents must file SS-5 to obtain a SSN...

K-1 is not a permamant resident and once the I-94 is within 14 days of expiring the person is no longer eligible to be assigned an SSN until they have an EAD card. You are not supposed to apply for the ITIN if you can be assigned an SSN at the time you apply for the ITIN. If you went by just being eligible, everyone is eligible if they can provide the right documentation. There is no ban on any group of people from being assigned an SSN

I'm just wondering should I rush to get my wife one. I'm beat with all this immigration stuff.

Getting a SS # isn't really all that difficult to do....I just took Atif to the local office with his passport w/I-94 and Visa, birth certificate w/translation, his EAD card [which just arrived this past Saturday!]......he filled out the application before his # was called and it took about 10 minutes at the window. The most aggravating part was waiting for his # to be called....and the person @ the window told us he SHOULD have it within one week [we'll wait and see on that one however :lol:]

About the ITIN....I learned when I filed for taxes last year, that unless both Husband and wife have a SS#, you cannot get the EIC for children...so now I have to file a 1040X for last year....

Thanks all for the comments...

It doesn't seem that bad so I'll try to go when I get a chance. For GP where we live you can get a Drivers License without a SS# and she already has health insurance under my name. She also will have no prob getting a job. But for tax purposed I definately need to get one.

Called State Dept. after not hearing anything since Sept. 23: Packet reached the consulate and was kicked back for a secondary security clearance probably do to her type of employment - Waiting for clearance and for superpacket to be sent.

How can she get a job if she has no SSN.... you need a SSN to work...

It is her that needs to apply for the SSN not you...

Not true. There are plenty of people out there that are employed without a SSN. If you wish to be employed legally you need an SSN.

Well I would hope that a Greencard holder would not work illegaly..... what would be the point in going through all the immigration stuff to then work under the table....
