just realized my checks are no good

Hello everyone,

I sent my AOS on august the 20th and they received it 2 days later. Today i started wondering why they haven't yet cashed my checks and after a brief reading here and on USCIS site I found this:

"Personal checks must be pre-printed with the name of the bank and the account holder. Also, the account holder’s address and phone number must be pre-printed, typed or written in ink on the check. All checks must be typed or written in ink."

After which I realized I don't have my name and address on the checks as they are one time checks issued on spot at the bank (only the bank and account info at the bottom).

My question is, what's gonna happen now? are they going to send my package back? can I send new checks? can I pay by phone? what do i do now?

One of two things: 1) the person accepting your file will notice and return the whole package, or 2) they cash the check and you receive the NOA1. This is like the "I wrote USCIS instead of DHS on my check what will happen?" thread. Just wait and see whether the check is cashed or you receive the whole thing back and proceed accordingly. I would recommend you re-read the proceedures as missing this may point to other little details that you might have missed and this process is all about the LITTLE details tripping people up.

The funnies/saddest thing is I hired a lawyer for the whole process and he screwed it up because I showed him the checks and he said they were fine.. now I'm thinking I did a mistake and should have taken care of all that by myself. another proof lawyers are not needed for the AOS process and I learned it in the hard way..oh well

day 86-- 07/05/2012-- Received my GC in the mail.

it has not been established yet that your lawyer (assuming you hired an immigration lawyer) messed everything up, right? for all you know everything is fine.. i used a lawyer in getting all my paperworks done from getting my gc to filing my n-400 and everything went smooth and fast.. don't stress about it.. now if you were denied because of the checks, then yes your lawyer is an idiot.. :lol:

on a serious note, call your lawyer and explain to him again what the form says re: the check, on how it should have been signed and see what he says.. good luck..

I guess as long as they are able to encash, you should be fine. :thumbs:

But sometimes banks itself return the checks without any names printed on them :wacko:

We used cashiers checks from my bank. The only things pre printed on them were the banks name, my name, Dept of Homeland Security and the amount. My address NOR phone number were on the checks. Now, while I have not called my bank to officially check to see if they have been cashed, I assume all is well because we have received our NOA by mail and done the biometrics appt. It took almost 3 weeks to receive them....

It has been 15 days since they received the package and no checks have been cashed yet nor the package has been sent back. Should I wait more or should I go ahead and send a new package with the right checks this time :)? I have the whole copy of the first package so it is really easy to resend it. I do appreciate all your answers.

Please please please please wait. I can't stress this enough. It can take up to 30 days to issue the Noa1 and cash the check. All kinds of problems can happen when you try to speed things up and fix things before you are sure they are broken. There was a recent thread where someone did this and it caused him months of hassle, and his whole file was severely delayed. Just wait, see what happens. Only if and when your package comes back, send a new one.

I suspect that if it was going to come back then it would have happened already.

You should absolutely not send a second file until you know what happened to the first. The most likely scenario is that they have accepted it and it is processing without issue.

a quick update:

yesterday my lawyer called to inform me that my package returned. the reason for the return was i forgot to "check" one section.. but it didnt say anything about the bank checks.. looks like the checks were not the issue. the checks were never cashed but they looked like they went through the system as they had a printed line in the back and in the front they had a stamp saying "U.S department of homeland security" even tho I wrote the same very clear by hand. I fixed whatever was needed and sent the package again yesterday.

Such a bad start to this long #### journey.. hope it gets better from now on :)

Did you tell your lawyer he's an idiot? I'm probably meaner than you, but I'd be pretty upset if the person I was paying all that money to let my stuff go out with something incorrect on it.

Anyway, good luck. I hope it goes smoothly from here on out.
