Dealing with Domicile RFE

So long story short, my husband(CDN citizen) was issued a RFE based on domicile at our interview in May. We were told that he should quit his job in Canada to show that we really intend to move and then send in that evidence. We haven't been able to do that since his is our sole income and we can't afford for him to quit his job.

I petitioned my congressman's office to have them contact the consulate. In my letter to them I mentioned a few things that were mentioned at the interview and said that we did have them available but were told at the interview that they weren't really what they were looking for. So the consulate replied to the congressman's office saying:

"If the petitioner can submit documentation supporting the affirmations included in her letter, it will be our pleasure to take the additional information into consideration to overcome the ineligibility.

Upon receipt of the documents, we will promptly review Mr. H’s case."

I sent in those things today. They were- copy of our daughters CRBA, her SS card, proof that I quit my job here in Canada, and proof that my husband has applied for work in the US.

Do you think that they really meant that the additional documents would possibly be considered enough to approve his visa, or is it just lip service?

Any insight would be appreciated! Thanks

If you haven't done so yet, you should read this pinned thread in the Canada forum - it addresses the exact situation you are facing: http://www.visajourney.com/forums/topic/164618-proving-domicile-when-not-living-in-the-us/

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Thanks Kathryn41, I had read that thread. It seems like Montreal changes their minds every few months since several things that other people have mentioned working in the past are not accepted now. It turns out that they did accept the additional documents as acceptable and approved our visa. I do wonder if the same documents would have had the same effect had they not been submitted on our behalf from the congressman's office, but I'm just glad that it's approved and now we'll once again play the waiting game and wait for his passport to be returned :)
