Visiting on a B2 while waiting for K1 NOA2?

Timeline

South African fiance wants to visit for the holidays and hopefully stay 6 months on her B2 visa that expires in 9 years, or until NOA2 and interview is scheduled back home. She has had a B2 visa for over 8 years and has visited many times before we met. The K1 NOA1 was early June. What are the chances of getting 6 months and are there any tips to make this process go smoothly? Will the 129F in the system cause a denied entry or any other issue when she enters? We will both return to SA for the interview etc.

Short answer.... if allowed.... no guarantees that you will get past CBP..... But not against the law either.....

short answer..yes you can visit while waiting on NOA2 but no guarantee that you will get through. gotta convince them your going back home to complete the process

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

She has 6-8 weeks holiday saved up that she can take from work and then plans to go back. She was going to resign but now will hold off since there should not be much time left after she uses up her vacation time and when the K1 is processed since we are expecting NOA2 in Nov-Dec. She has to use it or lose it. She also wants to get laser eye surgery when she comes and that will take a few weeks to do.

Curious.. does NOA1 show up in the system at the POE or only after they open the file and start processing it?

Now I dont know what to do! Help! :(

I was just reviewing the submitted I-129F packet and noticed there is nothing on the form that lists my fiance's passport number or other identification number. Therefore, how would the immigration officer know the K1 was filed (prior to NOA2) when she came to visit?

Prob they can lookup by First and Last Name and address.

f1000, My fiancé is planning to visit me in December and we also want her to stay for 6 months. I'm assuming by holidays you mean Christmas and this trip hasn't happened yet? Anyway, what kind of ties to SA is your fiancé planning on bringing? We're gonna make sure that my fiancé a copy of the I129f packet and the NOA1 but she won't have a job and she lives with her Mom currently. We're just struggling with how to convince immigration that she isn't going to simply stay in the US on this trip. Good luck with your journey and I hope everything works out for you two.

I know a couple of us in MENA had spouses who came on B2's. Mine stayed for 2 months and the other gentleman has a 6 month plan. They really didn't ask too many questions. They asked my husband's plan-- he was very honest. "I'm visiting my wife. yes I plan to immigrate and live here. Its my every intention to leave." They asked to see his return ticket... He forgot the confirmation at home, but still no problems. This was at Detroit POE. Of course he didn't come armed with tons of luggage or anything else that was suspicious.

Hope that helps! Perhaps we were lucky?

just got back from my US trip. my bf and i are also doing the k1. my situation was complicated since i brought my son with me who is a USC (got the citizenship from my bf who's filling the k1). i brought with me a lot of documents ie approved vacation email exchange from my boss (i made sure that his signature was visible to show that im emailing with my boss) (printed), certificate of employment, a copy of the noa1 receipt, of course return tickets, and a huge chunk of confidence and smiles. it was scary cuz the cbp was kind of hesitant to let me through. he was telling me that i will not go back home because my son and my future husband is there already. he just asked why would i go back home and told him that i still need to settle a lot of things back home and will have to wait on the approval.n i was given the full 6 months. :)
