Considering DCF (United Kingdom)

Hello,

My wife, a US citizen, should be receiving her ILR in a few months. I have read through the guidance for DCF and one of the criteria is to have help Perminent Residency for 6 months. She has lived in the UK with me for almost 3 years now however I think she will be classed as perminent when the ILR comes in. Does this mean we cannot apply via DCF from the UK until 6 months after her ILR is issued?

If she has legally lived in the UK for 6 months (not as a visitor) then you can file DCF now. There is no need to wait for ILR any more. It used to be that way, but no longer is.

I guess we will still have to wait for the ILR as the home office have her passport though. Or is that not the case?

Probably, as you'll need to send a photocopy of her passport showing her status in the UK.
