Hi,

here the situation:

I am currently in the US with a J1 Visa (2 year rule not applying) and will marry in 2 weeks.

Since my fiances income is not sufficient to sponsor me, her brother "volunteered" to be a sponsor for the Affidavit of Support.

At the moment we are both living with her brother, however, we plan to move by January into our own appartment (most likely be fore the interview...).

Is it better to have her broter fill out the I864A, since we is currently a household member or is it better if the fills out the I864 as a joint sonsor since we wil not be living with us any more at the time of the interview?

His income should be sufficiently high in both cases.

I864 is required, because the form will be adjudicated at the end of the process, after you have moved.

Thanks for your answer! Just to make sure:

My fiance and her brother both have to fill out a i864. My fiance as petitioner, her brother as joint sponsor.

When it comes to determining their household size :

Both do not have to mention their siblings at question 21g, correct?

Consequently the household income on both i864 forms will only reclect the individual income of my fiance respectively her bother?

They do not need to mention their other siblings unless they claim them on their tax return (which I believe is impossible unless one needs home care).

They each fill out I-864.

Brother has to make enough for him + you.
