Hi again

I've been posting in regards to what seems to be immigration fraud where as my husband is married to someone else .... but at what point he married her in the course of his relationship and marriage with me is yet uncertain ....... I would like to know if there is a way to acces marriage records in his country .....he is actually married to her but how he did so legallly I'm not sure .......... then it had occured to me that he may have two different birth certificates due to the fact that his step father adopted him ......... so there would be an actual live birth record (which here in the states would be sealed yet still a document) and then the public record ...... I happen to have the public record of his birth ........ it's worth a shot but I need to know if there is some central data base I can access to find this out

If you know the county in which he married her they will have a record of it.

What good will this do you? I hope that you are just protecting yourself and you have communicated with the consulate your concerns regarding he is married to someone else. He obviously has no respect for you.

Should he enter the US, you could "possibly" end up in all sorts of financial troubles and financially obligated (legally) to this man.

The concerns are great here.

EDIT: just for clarification... Are you the US citizen???

What good will this do you? I hope that you are just protecting yourself and you have communicated with the consulate your concerns regarding he is married to someone else. He obviously has no respect for you.

Should he enter the US, you could "possibly" end up in all sorts of financial troubles and financially obligated (legally) to this man.

The concerns are great here.

EDIT: just for clarification... Are you the US citizen???

She's the USC and he's already here in the US. If my facts are correct from the other thread.

This document that she seeks may be the difference between a divorce and an annulment.

OP have you tried talking to the consulate there? Maybe US Citizen services and see if they have any suggestions?

I also sincerely hope you have contacted USCIS. I have seen horror stories about women who wait to long and the male turns to VAWA and then nothing you can do...!!!!

Please contact USCIS/ICE ASAP and get your concerns on record...!!!

Thanks for your responses ...... I am the USC and my husband has been here since april 2012 ... and yes the reason for trying to find the date is so that I can have the marriage annulled if it applies .... at this point his other wife has told me their marriage was on June 22, 2012 but it took her a long time to remember the date ... especially the year ... that raised some eyebrows

I already had contacted the USCIS and they told me that there was no paper work or forms to fill out but that I should send a letter with any documentation that will be kept on file until his adjustment of status comes, where at that point a judge will make a decision on his behalf ....... I might be expected to make an info pass appt but besides that there is nothing else I could do at this point but to register my affidavit and evidence ....

So as of now I'm just trying to put my opinions and emotions aside so I can get the story straight and document the truth objectively and accurately

You would need to know the city they were married in and also what type of marriage, muslim, christian or traditional.

It would be very hard to do it from the US and you would have to have someone over there inquire on your behalf. Someone you can trust 100%, not family or mutual friends of your husband in this case.

Hiring a lawyer over there to help if you can trust him and if he won't ask for an arm and a leg.

Maybe a church affiliation that you trust and know.

If he is indeed married already then he was ineligible for his visa that he entered with and therefore you have a very good

case if you can proof it.

I always say when I read posts of marriages gone bad, to move on, let it go and let immigration worry about it but in this case I must say this is too much, too blatant and in your face scamming and he needs to be deported.

It is also a good reason for an annulment versus divorce. The whole thing smells of a very planned thought out act of fraud if he is married. What a creep !

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

That sounds like she is in on it and probably lied about the date. Their child was born in May this year ? Where is she ?

I also have to ask, what adjustment of status, doesn't he have his 10 year GC ?

All I know is he can't be legally married to both of you and he will have serious consequences to face.

just to help clarify things ................ my husband came here in april 2012 on a CR1 (Conditional Residence visa) .... we had onlly been married for 1year 10 months and under the CR1 this means he has to take 2 years to prove his worth... so to speek ... before he obtains permanent status ... as of now he is on "conditional permanent status" .... .... had we been married more than two years he would not have had to obtain the AOS (adjustment of status) and would have been given full permanent residency upon entry into the USA........... as to your other questions he was married while still in his home country before ever coming here ... even though not a legal marriage it is a traditionally religious sanctioned one ... I've discovered he "married: her in June 2011 which is almost exactly 1 year after he married me ...... she is still there in his country with what seems to be no apparent desire to come here, but who knows ........

You're talking about removing conditions. Not adjustment of status.
