First off, Hi everyone. I've been browsing the forums here for a few months now and have just now registered. I want to thank everyone here in advance for all the help you guys have been to one another, and to myself.

Hopefully someone here can point me in the right direction. Here's my situation: I received a letter from NVC stating they will be forwarding my approved I-129F petition to the U.S Consulate in Ho Chi Minh City on July 20th 2012. It also stated my fiance will soon be receiving a packet with instructions from the consular. I'm guessing this is the elusive Packet 3.

While waiting for the packet, I followed the instructions in another thread here and got my IIN number. I went to the link and entered the number to pay for my AOS/DOS fee. I was unable to pay the fee. Instead I received a message stating my petition has been forwarded to HCMC Consulate and my payment could not be accepted. I called DOS and they told me package 3 was sent out August 2nd. We have yet to receive the package. I went ahead and downloaded the package and had my fiance sign it and send it in last week. I called DOS today and they told me package 3 has been received but there is no appointment date set. I told her I was not able to pay the AOS fees and I never had a chance to send it in. She said she could tell me anything about that and it would be best to wait until package 4 arrives. I'm afraid since package 3 never came that package 4 will also not come. Also, I'm afraid something went wrong because I was not able to pay the fees and therefore never turned in my AOS. Please help me if anyone has had a similar experience. Thank you all again in advance.

K-1 process doesn't require to pay AOS fees! I think you mixed-up with the CR-1/IR-1 spousal visa proces which requires to pay AOS fees online!

AOS process is done after K-1 is issued, and once you guys will be married and in the US.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

If that is the case then I would be so relieved. It got me worried big time. This whole process can be so stressful but the big payoff is priceless. Thank you for your help.

You will have to pay visa fees though, and I don't know how your consulate wants you to pay them. But certainly not AOS fees if you're doing the K-1 process. :)

To be more clear, AOS= Adjustment Of Status.

K-1: Once the K-1 visa is issued in her passport, your fiancée will enter the US and you will get married in the 90 days after her entry. That's after your marriage that she will have to adjust her status by filing for AOS (and then get permanent residency=green card).

Spousal visas are different, and require to AOS first in order for the spousal visa to be issued. Therefore, spouses with a spousal visa become permanent residents as soon as they enter the US with their visa.

Op - Unless things have changed from last year, the fee needs to be paid at the Citibank office stated on the packet 3 or 4. Cant't remember which. Once paid, have your SO take the receipt to interview. I hope this helps.
