Is K1 right for us??

Hi Everyone,

My fiancee and I have applied for the K1 visa (we just got our NOA1 back) I am from Aus and here on a tourist visa and she is a US citizen. We are travelling back to Sydney to be together while we wait for the visa to be approved and before we go we are trying to get as much sorted as we can for the wedding which we have planned for April. It is really frustrating to not have a date so I wanted to ask if anyone knows if there may be a better option for us to explore i.e. getting married in Aus or perhaps a CR1???

What do you guys think is the K1 the right option for us.

Also if it is do you think planning to be back in the US for a April wedding is too optimistic?

Our petition is with CSC.

Also, does anyone know if I am able to enter the US on a VWP while waiting for the K1?? My fiancee's parent's 50th wedding anniversary is in December and we obviously want to be here but I am worried I may not be able to due to my pending K1 visa??

Difficult to know if you will have your visa by April. We started our K-1 process last year at about the same date (end of August), and I got my visa in hand by mid-April. My case was at CSC too, although it doesn't mean anything, as the processing times for CSC and VSC tends to move a lot over a year.

It also depends on your home country, some countries are faster/slower than others to issue an interview date/send the visa.

When you start the K-1 visa process, best is to NOT make plans for a wedding date. Usually, and what is advised, is to get married civilly after getting the visa (in the 90 days after entry in the US), and then make plans for a wedding with family and friends at a later date (the one you want).

If you decide to stop the K-1 route, be aware that you won't be refunded of the $340...

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...
