I went to CA DMV today and they wouldn't issue me a licence in my married name even though I presented them with the original marriage certificate. They said I have to have it changed first on Social Security Card. I was o.k. with that, and went to Social Security office, and they said they won't change it until I get employment authorization card.

Does anyone know if EAD will be issued in my married name if I just use that on the I765 form?

If you only want to right now change the name on your SSN record to get a driver's license, you can do that without an EAD card as long as your marriage certificate has your age or date of birth, just that you won't be issued an SSN card in that name until you do have an EAD card.

Just ask for an SSN Verification Printout to give you some proof of the name change until you get your EAD card and are eligible to be issed an SSN card. They you only need to apply for a replacement card, since your SSN record has already been corrected.

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change (e.g., a name change).

If the alien provides documentation supporting the change, process the SS-5 to update the Numident information but suppress the issuance of a card. (suppress issuance of the card, and see RM 00202.320 for providing SSN Verification Printouts.)

B. POLICY

Under the Privacy Act, an individual has the right to a copy of his/her SSN information, including the Form SS-5 or systems-generated application, and the Numident printout.

replacement card generally cannot be issued to a NH who does not have current work authorization or a current valid nonwork reason, the SSN verification printout may be provided after the identity of the

-- The marriage occurred within the past two years

-- The marriage document shows sufficient identifying information, e.g., biographical data such as age, date of birth or parent's names, and

-- The identifying information matches the information on his/her current Social Security number record.

The applicant will need to submit an identity document in the old name along with the marriage document if:

-- The marriage occurred within the last two years and has biographical information, e.g., age, date of birth or parent's names which does not match our records, e.g., the SSN record.

-- The marriage occurred within the last two years, but does not show biographical information, or

-- The marriage occurred over two years ago (with or without biographical information.)

The identity document used to establish the old name must match the name on the current SSN record. The identity document is acceptable even if over two years old or expired.

Hmmm... guess I was lucky then, I went back to the SS Office one day after I got married, showed the marriage license to them and after 5 days I received a new card with my new surname. :blush:

Not really. All depends when your I-94 expires. If yours was not within 14 days of expiring the name change could be processed without an EAD card. From her timeline she arrive in July, so her I-94 is expired and she needs an EAD card or I-551 to be isssued an SSN card.

Yodrak, I guess you are right. I've used my married name on AOS and EAD forms, and am hoping that they will issue me an EAD in that name.

i only showed my marriage license and there was no worries getting my SSN in married name. I made sure when i first got my SSN in maiden name i asked what are the procedures in changing to married name and they said all you need is marriage license. I would ask to speak to a manager. good luck

8th of May 06- K1 Visa Approved - phew

12th of June 06- Arrived in USA san fran- yeaaaaah!

1st of July 06- moved to tampa florida

15th of July 06- Applied for SSN

2nd of August 06- SSN arrives in mail!! woohoo

2nd of September 06- Max and I are married at Holy trinity Catholic church, el dorado California!!!

10th of October 06- package sent off
