If you want to pursue thing with ICE, pick up the phone and call. Don't wander around VJ building up support. Take your shot with reporting it. That's the only way to know if what you have as evidence is going to make be sufficient. My understanding is that you have to present a strong case for ICE to expend energy.

Also, divorce and move on from the marriage. Trying to exact some sort of "payback" is ultimately a waste of good energy.

I gotta say to the OP.....I hate to be a party pooper, but I walked down this road many years ago.

ICE does not really give a damn about your problem.....maybe they do, but they do NOT have the resources to investigate. To you this seems very important, but to them, they have much bigger fish to fry.

They will take your information over the phone, no problem, and that is where it will end.

You can continue to persue this if you like, but they have seen this so many times they are numb to your circumstance.

I think it is in everyone's best interest that people who have information about immigration fraud report it. I think it hurts our greater society to just say, "oh well, I can do nothing, so too bad." You CAN do something. You have proof of what appears to be a common immigration scam: keep old bf, marry American, then marry old bf at some point in the future and secure his place in the new country. I think the fact that on your wedding day, she posted a love note to her bf makes it very plain; it was an effort to build up confidence on a day that was difficult for the old relationship. That day should have been about your marriage, but instead it appears to have been a "trial" in the long term goal of this couple.

Of course, don't expect a miracle, and do expect to be in the dark about the investigation, but please make a report and let the professionals deal with it. You CAN do something, so please do it, for the greater good. We don't need people who prey on the good will of Americans in this country.

ICE may not deport right away, but this person has many hoops to jump through before she is really "here" in the US. Please make your report so the authorities can questions her when she continues her immigration process.

Oh absolutely report it to ICE, but what I am saying is do not let it consume your life. I felt very disappointed when I reported a clear cut case of fraud to ICE. And now, years later, the faudster is living a very nice life here. She still remains illegal as she has no way to adjust status, but her US government employee boyfriend is all she needs.

In agreement and resoundingly so.

I agree.

This is why I asked if is was OPs first marriage. For me the marriage would have been annuled the every first business day.

Some things you go to counsellings for and hope it improves, and then there are some things that are just instand and immediate deal brakers and unacceptables.

Let it go Man. You've done your part. If you don't have kids then no really any need to know what she's up to or who she's with.

I think you have a case for ICE, but

Get to yer local USCIS Office via infopass, and talk with the ICE Shift Supervisor. Bring yer file, ask for input.

Darnell,

This case sounds suspiciously similar to my case. Weird.

I've submitted a mountain of evidence and received zero feedback from USCIS or ICE. Yet my wife filed VAWA and get an EAD by providing USCIS with a multitude of lies and using a non-profit religious group. Let the lover beware. Women will do anything, and I mean ANYTHING to come to the USA. It is a disgusting abuse of the immigration system.

How exactly is anything he obtained done in an illegal manner? If he can view his wife's FB profile(s), then it's legal. FB is a public database. The point at which a subpoena is required would be when the FB profile is hidden or deactivated AND it is required for court. The only court matter would/could be divorce. You can by all means check the OP's state's statute, but the statute usually defines things for electronic media as video and voice recordings where both parties involved need to know a recording is being made. No I'm not a lawyer, however I have access to my particular state's statute and I have looked into the matter for using FB from a crazy ex posting about stalking me, for matters at which I will not discuss. And you can read the privacy part of the user agreements to FB, YM, skype accounts.

The OP should at least make an attempt. She can't really file for RoC without him (unless she tries to claim VAWA). It's better to try and fail than to just give in.

I agree - there's no indication anything was done in an illegal manner here. There are many ways this information could have been obtained that are perfectly legal.

Go to the police station and ask one or two cops to go with you to your house and ask her to leave. The cops would take her out of your house, ask them the police report ok. Surprise her and then she won't have time to "prepare" a Vawa case.

I bet she will file I-751 based in Vawa, then before she gets the papers ready for Vawa you should take some action. Hide all documents regarding the marriage, let her kill herself trying to prove a bonafide marriage.Call ICE when she leaves, divorce and move on.Good luck

Thus shouldn't work but I stand to be corrected by documented examples.

She lives there, her clothes are there so she cannot be mandated to leave.

Even if they were not married, which they are, he would still need to file eviction, etc

Gowon are you taking about the law in your home Country right? In AMERICA He doesn't need an eviction order to kick his wife #### from his house, and vice versa.

Several people that i advised to call the cops they called , and the cops waited 1 hour until the individual took the stuff. Its not a big deal. Including one person here from VJ last week called the cops and they went there and waited one hour until she took her clothes.
