Why does the Administrative Review process take so long? I am sure that USCIS does not treat every application fairly. Depending on where you or your fiance(e) is from, they will make it absolutely difficult and drag out the process. If my fiance were in say London, he would have been here by now. But because he is in Africa, we have been made to wait over 1 year now.... and counting. His interview was over 4 months ago. I just feel very down and depressed. I don't understand why they must treat some like criminals, and others like kings & queens. I apologize, I am just extremely frustrated. Thank you for reading my venting :)

africa has a lot of immigratiom freud,so your put in administrative review, more back round checks then normal more data base it takes longer.sorry your going through this it takes a long time for them to make a decision, i know how you feel frustated.i hope it turns out ok for you.

Because bad people make it harder for good people. Unfortunately, MENA countries have a high incidence of fraud. Thus, the process becomes stringent for those areas. It is an attempt to weed out the fraud.

Thanks. It is very frustrating that's all. I wish there was some other way or process we could try instead. I am quickly losing hope.

Red the Islamabad AP thread.Pakistan are thrown in to Mandatory AP and some been waiting over a year and longer.

So I gather you were denied at interview and your case is being sent back to USCIS and you are waiting on a decision? It is time consuming its not like they are jumping over barrels to rush to render a decision I am afraid. Its alot of time.

What was the reason for denial? Have you been able to address the denial issues and be ready with evidence to combat it?

Because if you get a NOIR you will only have 30 days to present your evidence and send in. So you need to know if you don't already know why the denial and what you need to do to overcone it. I gather your case has already left the embassy?

It will be okay but you have to get tough and hit them with what they want evidence. And sometimes that may mean cancelling this petition and getting married depending on why you were denied.

No, we were not denied. Our case is still under "Administrative Review." After his interview, it all went well and the Consular gave out positive vibes. The case was taken to AR and we are still waiting. I don't even want to think about what I would do if we were denied.

It is not surprising that AP/AR takes place after an interview. The CO will let you know if anything else is needed from you

or if the visa will be refused or approved.

Our case was in AP 17 months and then the CO refused the issuance of a visa and returned the case back to USCIS with recommendation for review.

You can call DOS for periodic status updates. 202-663-1225, press 1,0.

If, after 12 months or so, you have had no status change you can do a senatorial inquiry.

There is nothing anyone can do to speed up or end the process of AP/AR.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I was about to tell you, AP/ AR doesn't mean the visa is approved or denied. It means they need to do more checks to then decide. So, it could still be denied :(

The background checks are for national security. If your SO has a common name it may 'hit' the list of terrorists, pirates, etc. They want to make sure you aren't petitioning for someone that a) is a threat to national security and b) isn't lying to the US government and to you. It's not they're discriminating just because they feel like it. It's because unfortunately the country is notoriously known for fraud. So yes, it's true someone from a country like UK or Australian isn't as scrutinized as someone from MENA. If you hit the 'red flags' that makes it even more difficult.

administrative review is NOT a denial, it is done for further background checks not sent back to the USCIS. If your case is sent back to the USCIS it is a sent with the recommendation to deny or revoke..2 different things totally
