I know it's possible for my fiance to come visit me here in the U.S. while our visa is processing. And i know what type of info. to bring to show ties to his country. But he does not own a house or pay any utility bills. He can bring paystubs from work, bank statements, and a letter from his employer stating when he will be returning back to work. Plus he'll have his return ticket for like a week later. Anything else that could be helpful?? I don't know if just that alone is going to work. We're gonna give it a try and hope we didn't waste a couple hundred dollars for no reason. Do u guys think we have a chance?

Melissa1,

My sense is that ties to the home country are pretty much useless when one is into the K or immigrant visa process. Whatever the ties, the person is already about to sever them and relocate to the USA as soon as the necessary permissions have been given.

What is more important is being able to demonstrate that the person does not intend to immigrate on this particular entry, that they have a specifice plan to accomplish for this particular visit, a plan that is temporary in nature, of short duration, and that calls for the person to depart when the plan has been accomplished. See 9 FAM 41.31 (Visitors) Notes, N3.1 and N14.1-1.

The best evidence is the person applying for a visa or for entry, how they present themself and how they present the reason for their visit. If things get to the point of examining documentary evidence of ties to home, the 'battle' is already lost.

I crossed a number of times into the US while waiting for our K-1 to be processed. Each time I brought with me a variety of up to date documents showing my attachments to Canada. I was taken into secondary twice and showed my documents. I was allowed to continue each time, so just make sure the evidence is strong. Bring all that you have listed, plus things like a copy of the submitted I-129f package with the NOA1 indicating intent to follow the legal process, copies of any invoices for bills outstanding on a regular basis (insurance, credit card, etc.) showing Canadian accounts, rent receipts fo rmost recent month or lease agreement, renter's insurance for property, phone bill for current phone, car ownership registration for a vehicle still in Canada, etc.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
