It sounds like he has grounds for a restraining order or peace bond (depending on the state). Leaving him over infidelity is certainly reasonable, stalking him is not.

Hello everyone,

I have a very close friend who has a R1 visa (10 yr). We are not sure that his wife knows this. Anyway, they have been married for 3yrs 10months. She has set up a meeting with USCIS for this Friday to try to get him deported. She claims the reason is because he cheated on her with 15-19 different women. You have to ask her on any certain day the number of women will either be higher or lower depending on her mood. Anyway, she has abandonded him over 6 months ago and has left him several times in the past. She has taken all of his money and now is trying to destroy his career and reputation. He is an Author and Art Historian from England. She (along with her crew of bitter divorced wives from a trailer park who will lie for her) has posted things in the public eye as libel and slander. Even contacting the TV News that he was interviewed on as well as radio programs and said that she would show up to prove he is a fraud at book signings. We have proof of all of this. On a constant basis and in public she has threatened to get him deported and has more than enough evidence. My questions are:

Can she get him deported on a 10 yr visa if she claims he has cheated and has women who will lie and say he has?? Even if true, adultery can be explained away.

Can she get in trouble for abandoning him?? We'll have to define trouble but a Lawyer will certainly be needed.

Can she get in trouble for mentally abusing him with these threats and trying to destroy his career?? Absolutely.

There is an IR-1 and CR-1. No she can't get him deported. Getting a restraining order would help with the slander and harassment.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Sounds like a big mess, but the salient point is that your friend's status, based on what you've said and that has been discussed, cannot be taken from him - at least not for what is being discussed here anyway...

11/29/12 - AOS Interview in Atlanta - 10 minutes long and approved on the spot.

Is he in fact doing all the things she is acusing him of?

USCIS is not the "Bad Judgement" Police.. Only way to get him deported is to have comited some sort of felony or have lied on any of the immigration forms..

But having marital problems is not a crime.. Doesn't "threats of Deportation" qualify as grounds for VAWA? Just curious..

He doesn't need VAWA. He has a greencard already. All he needs is proof he entered the marriage in good faith to file ROC.

Yea, thanks, but just curious... under other curcumstances.. wouldn't somebody needing to do ROC qualify for VAWA if the USC was constantly making threats of deportation?

Divorcing and filing ROC as divorced is also a solution to simply get away from the abusive relationship and better own situation. Mental abuse is hard to prove unless it's backed up by proof. For someone who already has a greencard, VAWA doesn't quite apply. While it is possible, the standards are so much higher than just to prove the non-USC entered the marriage in good faith.

Yes, he has a green card. He showed it to me this weekend. I actually was looking at it specifically to identify the expiration date. I didn't realize that there were so many different types of Visas out there. I should have paid closer attention.

A Visa is not a green card, a green card is not a VISA .

Please look again at type designation printed on the green card.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yeah, I would look into a restraining order. If he has a 10 year card, no, she can't divorce him unless she has absolute proof that he ONLY got the green card for immigration benefits (usually they'll have proof of another wife or an e-mail/phone message stating how much they would pay the petitioner).

Cheating is not deportable. They entered into a valid marriage as far as USCIS is concerned. He has NOTHING to worry about. She would need mountains of proof for this. She signed the AOS and removal of conditions support documents. Nothing she can do now. She's gonna look like a crazy person. He should file a restraining order against her it sounds like. She's a bitter woman seeking revenge. Whether he cheated or not is irrelevant at this point.

I apologize if you think that I am trying to stir up people. I am not. I really have searched the internet for this issue and can not find it anywhere. The real question is: can she deport him on a R1 10 yr visa through a falsified claim that he cheated on her within this last year?? They have been married for 3yrs 10m. She set up an online appointment with USCIS this Friday. He is scared, really scared of being deported. He left everything when he moved to the US. How deep will USCIS look into this or will they just look at her like a bitter ex??
