Help Refusal! Casablanca 221(g) for CR-1, but no return to USCIS stated

Hello,

I didn't know that i was carrying a 221(g) on my way back to home, i thought it was just a matter of a phone call as the consular officer said " ..mmm, until i'm convinced i need to review your proofs of correspondence between you and your wife, then we will call you" but i was already given a 221(g) even before facing the CO but i found that out just today. The 221(g) was given to me - obviously i didn't know - along with our forwarded original documents from NVC, it was about 1 hours before the interview, a lady behind the window asked for my medical examination (i thought she is the CO but she wasn't) then she gave me a bunch of our original documents, but they were yes, our original documents + 211(g) that was mingled with the original docs. Is there anyone heard of similar incident? who is supposed to hand me a 211(g) or an approval, isn't it the CO?

Anyway, my 211(g) does not have the CO's handwritten statement - as it is the case for most 211(g) - that says " your file is being returned to the USCIS for further review" , i was just told by the CO that she's gonna review our proofs of correspondence (emails,cards,letters,etc...), she did not ask me for our photos together, or federal tax returns or other evidences, i think because we have submitted that last year to the USCIS (request for evidence) REF, i don't know why things were not as i expected.

DO i need to have my wife contacting her congressman/senator at this point? How can we know what's really happening to us without contacting the consulate as they don't answer the phone? Is it a possibility that eventhough my 211(g) doesn't have the " your file is being returned to the USCIS for further review" it could still occur?

What does the 221g say? Second did they keep your passport? Bottom line you got a 221g when they decided to review the case is irrelevant, they will review and let you know. In our case it was a 62 day wait before my husband got called back for a second interview then they decided on an approval. You need to call DOS as stated earlier they can tell you what type of review you are under if at all (AP - local, AR - at DC). Either way it could be a long wait. The state department website states if placed on review call for a status update after 60 days. Dealing with consulate is for not they will not answer your questions. We had a friend with same situation as ours and he got called for second interview after 14 days and was denied. There is no way for anyone to predict what they will decide. If they kept your packet or visa they are still processing the request for a decision.

Our 221g stated they were reviewing our conversations.

Thank you, do you know the DOS hotline number? My wife tried reaching, but each time she gets the responding machine then to waiting for 20 minutes with no representative showing. Please share with me the DOS number that you know, or any DOS phone number that we can use, much appreciated.

Were you given a 221(g) that does not say your petition is being returnned to the USCIS? are you through CR-1?

What does the 221g say? Second did they keep your passport? Bottom line you got a 221g when they decided to review the case is irrelevant, they will review and let you know. My 221(g) does not say anything ( i'm attaching the copy of my 221(g) along with this reply).

They didn't keep my passport.

My wife called the DOS but she had no success to talk to any person, the machine put her on await several times.

My wife called the consulate 5 days after my interview, she found out that i'm under AP but my petition wasn't returned to the USCIS.

I have some updates: I've sent an email to the consulate, specifically to the CO, i knew her name because she was the same person who notarized the summary of my marriage certificate earlier (2 weeks prior to my interview) at the American Citizen Service (ACS) of the consulate, i had to do that because the NVC rejected our original marriage certificate that we submitted to them and which was approved previously by the USCIS (i didn't know why!!), the NVC wanted our marriage certificate to be issued by a Quranic Court which what it was, as we got married here in Morocco in 2010, so was pushed to make an appointment with the consulate in order to notarize the summary of our marriage certificate which what was done by the lady who, later will be my CO to interview me, and who interrupted me severely when i tried answering her questions and to clarify very important things to her regarding my employment and the money transfers I've received from my wife throughout the 3 years & half. Unfortunately, because i had to be polite & courteous, i surrendered to let her ask further questions.

One of the consulate representatives called me the next day after my email to them, he explained that the NVC didn't send my I-130 along with the packet so my case is pending!!! i said why, he said, it's an error we're sorry but you should know that your petition is not leaving Morocco for any reason. I received an email from the consulate on the same day saying the same thing, despite their auto-response email that tells people to allow 10 days for the consulate to reply.

So, I'm under AP and my I-130 has not been forwarded from the NVC along with other documents, i think the I-130 is the most essential item in there!!

What do you think i should do, knowing that my packet is remaining ? and please, could you explain what the local, AR - at DC mean ?

Your wife should email the consulate, explain the situation and request an update. Does the 221g have your name and case info on it?

Thanks for the reply, No the 221(g) i got don't have my name and case info on it, what would be the difference if my 221(g) has those information?

You have 'basic' administrative processing. The IV Unit is not finished processing your casefile - something is off on their timing. Could be namechecks, could be security checks. Per 'that letter', Casablanca IV needs nothing more from you.

You must wait till they be done.

You can ask your USCitizen Spouse to call into DoS Hotline, once a week or once every two weeks, and ask for casefile status.

At some point, the administrative processing/administrative review will be completed, and the casefile status at DoS Hotline will change. When Casablanca IV is finished (per that letter), they will telephone you.

Thank You, i got the DOS hotline # from your page, it's the same # my wife called several times but the machine kept her waiting, yeah she needs to get a human by pressing 1 and then 0 for a live operator, got that, thanks.

I have updates: last Thursday the consulate called me, they said that my I-130 has not been sent from the NVC along with the other documents. The consulate replied to my email as well, here's what their email says:

" Dear Sir/Madam,

Thank you for your e-mail.

Your case is pending. We are awaiting some documents from NVC to continue processing Mr. Lachgar’s visa. We will contact him as soon as we can continue with your case.

We hope we have been of assistance to you.

Regards"

So, i got the 221(g) AP, and also my I-130 has not been sent to the consulate, so i had my interview without my I-130 being there! the consulate's representative described that as an Error.

I need to mention that the NVC on the last stage prior to the interview, rejected our original marriage certificate which was previously approved by the USCIS, they said that our marriage certificate needs to be issued by a religious (Koranic) court! so i started working on it, but while doing that THEY SCHEDULED MY INTERVIEW! eventhough i haven't provided what they needed.

whew ! then it's not so bad. Just some documents to chase down. Relax a bit, bug NVC , get a SuperVisor and see what's up.

That I-130 is supposed to be in the SAFEFILE network, so you can have a Supervisor review:

1. list of items that went out with the casefile, from NVC to Casablanca

2. verify that the I-130 was IN the casefile or not

3. verify that the I-130 was STORED already in the SAFEFILE network .

If you are stuck without using a telephone into NVC,

email them instead, with a subject line of 'SUPERVISOR REVIEW'

and that email will be reviewed same day, or next day.

That I-130 is supposed to be in the SAFEFILE network, so you can have a Supervisor review:

1. list of items that went out with the casefile, from NVC to Casablanca

2. verify that the I-130 was IN the casefile or not

3. verify that the I-130 was STORED already in the SAFEFILE network .

If you are stuck without using a telephone into NVC,

email them instead, with a subject line of 'SUPERVISOR REVIEW'

and that email will be reviewed same day, or next day.

Update: my wife (petitioner) called the consulate to find out that NVC sent my I-130 to the consulate.

My interview was on Aug 23rd 2012, CR-1

Got the 221(g)

then been informed by the consulate that my I-130 is missing = case pending ( does that mean the AP is pending too?)

Now that NVC sent my I-130 to the consulate, knowing that the consulate's representative explained to me earlier that the 221(g) i got didn't result in a returning to the USCIS, what can you forecast? Thank you
