Ladies and Gentlemen

I would like your help very much on the following issue,

I am an Indian National. At this moment, I was living in Germany. However, in order to get the Visa for my MSc studies, i need to get out of Germany, and apply again, because there is a change of school, purpose etc..

However, going back to India and doing it there, will make the situation almost impossible, because there 1. it takes too much time, and 2. they ask for too many documents, including K-10 grade reports...... and i got into the Uni not because i have good grades, but because i am good in the work, and have publications in that field. Anyway, the point is i dont have good grades to convince the visa people..

the other option is, to go to US, where my GF is, and to apply for my visa to germany from there. They do not ask for too many papers, and is FASTER.

The problem is this:

My current Permit in Germany ended. I am having the thing called Fiktionsbescheinigung, i.e. a permit to stay here, until the decision is done on my application to renew it. Although in general, I DO need to get out, but I was suggested by the international center to submit a written application, and get a written answer. So with this, i have a fiktionsbescheinigung.

Now, If this application is downed, i will get a 4 week extension of the Fiktionsbescheinigung, and i will have to get out within that time.

I ask now this: Is it possible, with this residence status to apply for a B-1 visa, to visit america, for MAXIMAL 25 days, to visit my GF, and unofficially, not to mention in the documents to apply for my Visa in germany FROM THERE ?

Now, I dont intend to stay in America this time. this time i intend to get to Germany, and i do not plan to stay more than 25 days, if that is helpful to answer. In fact i want to get out as soon as i get the visa to Germany - i want to do my studies here.

I would really appreciate, if someone could tell me, if:

1. in this situation, if it is at all possible to apply for a B1 Visa

2. how should i prepare myself? is there anything special i should keep in mind?

3. will my fiktionsbescheinigung (although i will not tell them, and it is NOT on my passport, it is a separate, credit card sized ID) somehow show up in the process and cause trouble?

PS: just in case, if it is necessary: My GF is an American national, by birth, and will sponsor my visit.

PPS: If possible, could you also please quote your source documents with your answer please - i will look them up, and read them, before asking the next question, should i have any! thank you very much.

1. I would think yes, as you are currently legally resident in Germany.

2. It will be difficult for you to get a tourist visa to the USA, because you have no ties to Germany and none to India, ie no reason to lave the USA again, at the time you apply for the tourist visa. Also, you DO have ties to the USA, ie the American girlfriend.

You should also check whether you can apply for your German visa in the USA- most embassies have a rule that you need to be legally resident in a country to apply for a visa from there, so as to prevent visa tourism, which is exactly what you are trying to do.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My tie to Germany is that I wish to leave USA within 25 days though. Because I have the admission to the Uni inn Germany. Well, I will have to check the Visa application possibility though.

You don't, though. Not until you get the German visa in the USA. If that is turned down, you are effectively "stuck" in the USA, from the US embassy's point of view. So I think getting the tourist visa will be difficult.

okey, what happenes, if i go back to india, from there, visit my gf for 15 days (not 25 this time),and actually come back to india to apply for my german visa? can i say that my actula reason to come back is the admission to germany, for which i need to come back to india to apply?

and of course, i will not say to the US embassy that i will apply for a german visa from there, because i myself dont know if it is at all possible.

i will leave US, as soon as possible, either by accquiring a German Visa form there, or coming to india to apply for a new visa, and the stay will NOT exceed 25 days. I cant afford a stay longer than 25 days, i want to do my studies in germany, and therefore i need to leave US, as soon as possible.

the main point is if i can visit her BEFORE i go to india and start the german visa process, the german visa process will be complicated, and take time.
