My husband submitted the forms asked for in the letter that was mailed to him. We made sure we got everything that was on the forms they sent.

However, when he went for his interview, he was told that we needed the 864 done for me and not for my co sponsor.

My question is, we have No idea if they accepted my co sponsor (which she wasnt labeled as a co sponsor because not until reading here did i realize that i am the initial sponsor and she is the 2nd joint sponsor (is this correct)

So what i am thinking to do is to send in my 864 and have her redo her 864 and check 1st joint sponsor and 2nd joint sponsor.

also we calculated her income as a single person not as 2 person household does that mean that she needs to redo this portion??

does this call for resubmittion of the form as well.

And do i file with my sons and my husband so that my household adds him as well as her household adds him?

very confusing for me.

does that mean that you didn't submit the i864? the sponsor always has to submit the affadavit even if you are below the poverty guideline. you submit an i864 and mark I am the sponsor.

no, she has to mark I am the only joint sponsor. you are the sponsor and she is your joint sponsor. now, if you have 2 other people sponsoring your husband, then there would be 2 joint sponsors. but since you have only one joint sponsor, there is no other joint sponsor, she is the only joint sponsor you have.

in the houshold is at least 2, she has to include herself plus the beneficiary, she has to make enough income to cover herself plus your husband who is the beneficiary, so household size minimum is 2.

the beneficiary is always included in the household size

Yes you will have to do one and your joint sponsor has to do a new one with 2 in household. I believe the guideline income amount is $18912. Do not count your husband in your household count.

The petitioner counts the intending immigrant and then leaves the spouse box blank further down to avoid counting them twice. We don't know the size of the joint sponsor's household. It is what it is, plus the intending immigrant.

The best solution for the OP is to submit a new I-864 for themselves and new one for the "only joint sponsor", so that the affidavits are both properly filled out.

Sorry sure didn't mean to confuse or be convoluted. :blink: Sorry Reh, you had stated the joint sponsor had filed as single instead of 2 thast wher I based the they needed to do a affidavit based on 2.
