I dont know if this is the right place to post my questions. I am a US Citizen, I petitioned my parents last year. My dad went back home to the Philippines January of 2012 because he dont like the weather here, it was winter when he came here but my mom decided to stayed. It's been seven months now that he is out in the US and I asked him if he wants to come back and he decided that he wants to come back. Now, my questions are;

*Can he come back after seven months with out any problems at POE?

*Does he need a Re entry permit or not?

Thank you... :)

he can still come back, he might be questioned at the POE, but he does not need a reentry permit, but he should come back as soon as possible, now if he can.

Thank you for your quick reply. Yes, I am working on it fro him to come here next month. If he does not need a re entry permit, what would be the worst possible if the POE officer is not satisfied with my dads answer?

hey! My friend is an immigrant but she decided to go back to philippines to study. i believe she has to pay something every 6 months for staying in phils for so long. you may want to check on that. i believe your only supposed to be out of the country for 6 months. i would call USCIS to be sure.

incorrect, a reentry permit is necessary when a person will stay over 1 year up to 2 years.

if he comes back 8 months is less than a year, so no reentry permit is necessary.

they might give him a hard time, but he will be able to enter. his GC is still valid.

yes and if you read it, it says you don't need a reentry permit if you have been abroad less than a year. plus one has to file and be in the US to file the reentry permit. you will have to do fingerprints for biometrics.

if he leaves now, it is less than a year, but more than six months.
