Hi,

I just have a few questions regarding I-864. Im about to adjust my status and my husband is below the poverty line. So we have my uncle to be the joint sponsor. We have his 3 year tax transcripts. 2 years before he filed his tax jointly with his wife but he filed by himself for last year. Would that be a problem? I have his tax transcripts and a proof of employment from him as well as a copy of his passport.. is that enough or would I need anything else?

Another question as I am completely confused with these tax things. (sorry) My husband has his tax transcript from last year 2011 but he apparently didn't file for his tax the previous 2 years. He's not sure if he's required or not. Would it be possible to just submit his recent tax transcript or do we still need the past 2 years since we know he won't make it above the poverty line anyway?.. He wasn't given a proof of employment but his company gave him his pay stubs which they say is proof enough. We have his paystubs, W2's and again I'm making a copy of his passport.

Is there anything else that I need?..

About the taxes: It really depends on if he filed HOH, which he isn't eligible to being married. Basically immigration looks at how much money he made, verifying that amount (filings, tax trans scripts as well as the matching W2s) and then on the I864 your uncle does need to fill it out correctly that he is married. As long as he makes enough to support himself, his wife and the immigrant then that part should be ok.

You also need a letter from his employer verifying employment. (Employment verification letter)and his jobs human resourse department should be familiar with these and what information is needed. About your husband. 3 years is what's needed. If he didn't file then a letter from IRS would state there were no filings for that year on record and your husband would have to write a letter explainging why. If you don't submit it you will get a request for information from USCIS wanting those documents.

W2s are already needed as part of the financial support documents so it cannot replace another document (letter of emoployment) that is needed. The letter needs to be on company letterhead (preferred) and give the employees name, his length of employment, job title and supervisors contact information. Your husband and uncle will also need to send in proof of US citizenship. For me US passport wasn't enough. I also have to give a copy of my social security card, state ID and birth certificate. You may also have to establish a relationship between your husband and his uncle and prove they are related. For example, your husband would submit his birth certificate then that of his parent whom he's related to his uncle through and their mother's birth certificate. Then the uncle submits his birth certificate then that of his mothers and that would connect them as proof.
