will our CR-1 be treated as DCF automatically

Hello, I am new to this field, didn't know about DCF until yesterday (lol) So I might be asking some stupid questions here so please bare with me...

I went to US embassy website for the Netherlands, it says

Effective August 15, 2011, petitioners residing overseas

will no longer be able to routinely file Forms I-130,

Petitions for Alien Relative, with U.S. Embassies and

Consulates except in locations where U.S. Citizenship

and Immigration Services (USCIS) has a public counter

presence within the Embassy or Consulate. Petitioners

residing overseas in countries where USCIS does not have

a public counter presence will be required, starting

August 15, 2011, to file their Forms I-130 by mail with

the USCIS Chicago lockbox.

There is no USCIS office in the Netherlands, so does it mean I have to file I-130 at Chicago, will it be routed to Ams or will it be processed in one of the service centres? Or I can send my package to USCIS office in Germany where they oversees Netherlands? I am just so afraid if I send my application to Chicago lockbox, somehow it will end up not being DCF...

No, you can't send your package to Germany, but you most likely will get the first part expedited, and save around 5-6 months that way. I-130s from abroad filed at the Chicago Lockbox have been being expedited. Read this thread http://www.visajourney.com/forums/topic/357465-usc-petitioner-living-abroad/

Hi, we both live and work in Amsterdam, my fiance and I met at work and he is here on a 2 year work project. We decided to move to the US after his work here is done (will be Dec), we didn't know DCF so we thought K-1 is the only option,,we filed K-1,right now we are 5.2 month deep in the process, while we could of got married and file DCF and be in the States probably by now :wacko: I felt lucky that he is here with me while a lot of fellow VJers suffer from long time separation :blink:

We don't know when NOA2 will come. Besides the endless waiting and uncertainty, we also just found out all kinds of inconveniences that a K-1 visa holder will be facing once entered USA, work, travel, drive...all of these hassle can be avoided if we filed DCF that's why we are considering withdraw K-1 and file DCF instead.

You will have to cancel/withdraw the K1 in order to file the spouse visa petition.

Chicago is the place where you would file the spouse visa petition, not Germany.

Thanks for the link, it is really helpful and I am now even more sure of cancelling our K-1, it sucks, we totally wasted the last 6 month.
