VAWA and EAD

hello everyone, i hope somebody has an answer for me. i filed my VAWA application in december 2011 and since then received my 2nd prima facie now but nothing else, no RFEs, no touches, it's still in initial review. my attorney filed I-765 and I-485 concurrently. i noticed in other people's timelines that many recieve an EAD before I-360 approval but my lawyer told me that i have to wait to get the approval first before the work permit. so now im confused, why do some people get theirs sooner and before the approval and some don't. it's been a struggle every day for me without one, thank you for your input

If you have a form I-485 and I-765 pending then you will get your EAD in three months .Those who filed I-360 without I-485 cannot get EAD before the I-360 approval, but it's not your case.Your lawyer information is not correct at all, you have a I-485 pending then you can get your EAD before the I-360 approval.

So you'll go back and look for your EAD now. But for our education: what have you achieved in 8 months of prima facie?

thank you for ur responses. all that happened is i've been waiting, they issued the 1st prima facie right after receiving my package, then we had to call the hotline to inquire about extension since the first one expired, shortly after they mailed me a 2nd one. other than that no changes at all, no RFEs and no touches.

so how do i look and try to find out why am i not getting my EAD, everything was filed together in december 2011, that's 8 months now. thank you so much

I am assuming you have received a receipt notice for your I-765 and I-485.

You can get an infopass appt at your local USCIS office and inquire about your application. Your local uscis office may offer infopass specifically for EAD application that has been pending over 75 days. Or Call USCIS hotline (you can find the hotline number on receipt notice) to expedite your EAD if it has been pending over 75 days. If you have I-485 pending you are eligible to EAD.

thank you for your responses, im waiting on my lawyer to write me back tomorrow to clear some things up. good luck to everybody in your journeys
