Hi all, I finally received my RFE for the AOS - which states that my hubby's income is not above the 125% poverty line (it is well above it) so I'm not sure how that has come about (sigh) anyway will send off documents again which they are asking for! :( always something huh!

Also I wondered is it just the financial side of things that they are worried about for my hubby? as I have no credit here in the US, and what are they checking for ? just to see if he has enough income? I'm a bit worried as I have zero credit ! (bad credit back home tho in UK !)

02/02/2006 FLY TO NEW YORK TO BE WITH MY BABY!!! WOHOOOOOO!!! so happy!

03/03/2006 Social Security Card Arrives weeeee!!

29/03/2006 AOS Journey begins - gathering paperwork to send off next week!

24/04/2006 Vaccinations: Diptheria and Vaccination Supplement form obtained

AOS is a bit of a pain here !!!

04/27/2006 AOS & EAD sent off to Chicago finally!!! weee!!!

05/03/2006 NOA for AOS & EAD recieved!

05/22/2006 Biometrics Completed :) - for AOS & EAD

18/01/2007 EAD Approved YaY!!

02/06/2007 AOS Interview - Pending once we submit tax form 05 & prior emails/

It has nothing to do with the nonUSC and having no credit ... Did your husband make well over the poverty level in 2005 ??

Send all the information requested and also write a letter explaining that your husband is not below the poverty level. Make sure you are reading the right years with the tables and send extra stuff if you can like tax transcripts, extra years, letter from C.P.A., letter from employer, new pay stubs, and anything you can think off.

In our case, it was that we sent the tax transcripts but not the W2s, so, I would add those, as well as the employer's letter, and paystubs and the letter explaining how you are above the poverty levels.
