I-94 expires and no SSN yet

Hey guys! What should I do if my I-94 expires in 2 weeks and i didn't apply for SSN yet? Do I still have any chances to get it?

Thanks !

You could try today since you still have two weeks on your I-94, but chances are they will deny it.

If they deny it, you'll have to wait until you get your EAD or green card.

You should be able to take it to the SSA office and apply for a SS or you can wait until you receive your EAD and then apply..

Step-by-Step Guide to getting a Social Security Number (SSN)

:: For K1 Visa Holders ::

As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior to the expiration on your I-94).

If you are a K-1 visa holder it may be too late. Does it expire in 15 days or less?

Extending stay does not grant one a SSN. Presumably the OP is a K-1 because they posted in the family-based (AOS from K-1) forum.

OP: If it's too late now (I think it is) then you can get one with the EAD. No big deal.

No you don't need to extend it. You are technically out of status if you don't apply for AOS before it expires. USCIS will forgive this when you file. You can apply for AOS at any time but I would recommend doing it as soon as possible. I was unable to get a learners permit until my GC was approved, and it took a while!

The SS office should be simple. Take the SS card application, you can find it here. SS card application

Also take your passport with valid I-94 and marriage certificate.

Please update your VJ profile so next time, we will see at first glance that you are a K-1. :)

Go to your profile page (click on your profile name) and then click on "Edit my profile" on the top right.
