**URGENT** Submitting docs on Saturday - Joint sponsor tax return

Hi all,

I have gathered all my docs and ready to submit them on saturday. I am a little bit worried because my joint sponsor just sent his tax return yesterday...He sent just the 1040 - which summarizes his annual income together with a letter from his work place stating when he started working and how much he makes per annum.

I don't know if that is enough. I am thinking I should tell him that I will be needing all his tax returns paper work including the W-2...Do you think that is necessary? Or should I just make use of what I have. Urgent advise is needed please. Thanks.

September 2010 - Came into the US on a F-1 Visa....still in-status.

October 2010 - Met wife - USC.

2011 - We realized we were already bf and gf....no formal toasting...lol.

January 2012 - Proposed to my wife.

June 2012 - Got married.

August 29 2012 - Mailed AOS packet to Chicago Lockbox. (Day 0)

August 31 2012 - AOS packet delivered. (Day 3)

Sept. 3 2012 - Received 4 emails/texts notification for NOA1 @ 7:59am PST (Day 6)

Sept. 8 2012 - Received hard copies of NOA1 in the mail. (Day 11)

Sept. 10 2012 - Biometrics appointment notice received in the mail. Scheduled for September 25. (Day 13)

Sept. 11 2012 - Successful early walk-in for biometrics appointment. (Day 14)[/left]

You will probably receive an RFE for his complete tax return, or a transcript, if you do not enclose his complete tax return initially.

What do you think you are missing? The 2011 1040 is the form most of us use to file our taxes. It's not "just a summary" but the 1040 is the form we are required to file.

If your joint sponsor makes enough the current taxes should be sufficient. There's no requirement to send 3 years worth of 1040s. It's good he provided a letter from his employer.

Our joint sponsor earned well above the required amount and we only submitted the tax information for the current year, 2011.

Thanks all for your reply. I am just scared because the 1040 he gave me is just a single sheet showing his total income. Is that going to suffice?

No, the 1040 should be at least 2 pages long if he's single.

Almost at the very end of the 1040 it will say Sign Here and there should be a signature and then a date. Is that there?

You need to call your friend and let him know you need a copy of the signed 2011 1040 that he filed with the IRS.

He can also have a tax transcript faxed to him - Call 1-800-908-9946.

Is your joint sponsor self employed or a wage/salary earner. A wage/salary earner should include proof of current and continuing income. This income claim is typically supported with recent paystubs and an employer letter.

A complete tax return includes the form 1040, all W2's/1099's, plus any other filed schedules. That is why the USCIS prefers the tax transcript. All the required information is in one document.

My joint sponsor is married and filed tax with his wife. He is also a salary earner. He didn't give me any W2 but just the first page of his 1040 which has their total income. With your suggestions, I think I will just have to tell him to give me all his tax returns document together with the W2. Or what do you think?

Thanks.

As I said, you can either enclose it all initially or you will be RFE'd for it down the line, which will slow your case down.

If your joint sponsor filed his taxes using an online service like Turbo Tax you will want to make sure that the 1040 is signed by the joint sponsor.

We filed our 2011 tax through turbo tax and I am currently preparing my docs for affidavit of support. Where should we sign the 1040? Thanks!

Look around page 4 - it's the page that shows the refund amount or the amount you owed.

You'll see the Sign Here . You'll want to sign and date the page.

Did your friend complete a I-864? Did he have the instructions?

You will either need a copy of his complete tax forms, W2s and any 1099s or a copy of his tax transcript and his W2s and any 1099s. FYI - normally W2s/1099s are not required with a tax transcript but if he filed married and you are only using his income then his W2s/1099s are needed.

Did he send you a copy (front and back) of his birth certificate or a copy of the biographic page of his passport?
