Hello!

Hope you're well

I am applying for a change of status and green card as i have married my love who is an US citizen.

I've been asked to produce my birth certificate however I was born in Thailand in a refugee camp during the pol pot regime, at the age of 18 months or so my family was accepted as refugees to Australia and 30 years later here we are!

My mother was never given a birth certificate for my birth and in Australia I have never had to produce one as my mothers citizen certificate sufficed. However US immigration has asked that I produce my birth certificate, has anyone been in this situation? if so what have you done? would the Thai Consulate help? I need help please :)

Any info or leads anyone has would be greatly appreciated!

There is information in the instructions of the I-130 petition - which your US husband needs to complete and submit along with your I-485 application to adjust status - that provides a list of 'other'' evidence when a specified document is not available.

Look at the bottom of page 4 on the instructions here: http://www.uscis.gov.../i-130instr.pdf

Basically, if there is no birth certificate you can use a statement from the appropriate civil authority that the document is not available and provide additional evidence such as church records, school records, census records or a minimum of two sworn affidavits from two individuals who were alive and can attest to the facts. I would suspect that including copies of your mother's refugee information and her processing through Australia including you on her documentation, along with the requested statement of non-availability and an affidavit from your mother and someone else who is familiar with your circumstances would work.

there is information on the Births Deaths and Marriages site in Australia regarding this. i.e. there is a 'special' style of birth certificate available for persons in similiar situation

I have to ask, What did you use to get a passport in Australia....? Shouldnt that work?

Thanks so much for getting back to me! i used my mothers citizenship certificate to get my passport - do you think that will suffice in this instance?
