I wanted to ask your advise. Interview will be on 9/28/12. Back in the year 2008 i applied for a tourist visa when i was still single. But ny wife and i were living together already at time our kid was 3 yo. I did not declare in my application that my son was an lpr already. I got denied. I went to europe for a visit 2009 and went back to us embassy to again apply for a tourist visa this time i did not write again my son or fiancee Will that be a problem for me ? Will they ask that to me too?

Personally, I do not think your previous visa denial will cause you a problem. I personally know somebody who was also denied of a tourist visa before but got successfully approved of a K1 visa very recently but then again, it's a case to case basis, so who knows.

Of course the onus is on the petitioner here as the beneficiary doesn't sign that form. There are strict penalties for knowingly and willfully falsifying or concealing a material fact.

Form I-130 Part C: question #17

Of course the onus is on the petitioner here as the beneficiary doesn't sign that form. There are strict penalties for knowingly and willfully falsifying or concealing a material fact.

I saw that it is not a K1 Visa, that is basically why I said it's a case to case basis because his case is different. I didn't assure him of anything. I just stated my personal opinion, didn't I?

For clarification purpose, as I may have misinterpreted some of your post. When the I-130 was filed, did you list your son or not?

No. My son is LPR already. Im talking about durin the time I tried to apply for a tourist visa. That's when I did not write at te 2nd page my son is LPR and my fiancee is LPR too.

OK I will ask again a little more specifically, when your I-130 was filled out, Part C question #17, it asks questions regarding you the alien and to list husband/wife and all children of the alien (you).

Was your son listed? If not, why? This could possibly raise questions.

Just be prepared to answer them honestly. No need to answer that question here. But, if they find out, they will want to know why he was not listed. Maybe it will be an issue, maybe it will not be an issue. Whatever you do, do not lie in the interview. You will be under oath.
