Hi,

I see so many different awnsers here so im hoping to get the truth lol.

I pay child support for my 2 kids who do not live with me, and I havent claimed them on my taxes for the last 2 years, now are they gonna be considred part of my household when I fill out the I-864 or not? Also I live with my father for now til my wife comes and I need him as a joint sponsor to make up the difference on my income from last years tax return, is he also gonna be considered as a household member?

Correct

IRS and USCIS are not related to each other, have different rules of what is a household. I also pay child support, IRS says not dependent, but needed to mention in USCIS forms.

If you live with your father and need to combine income with him in order to qualify, yes, you count your children and your father in your household size and your father provides an I-864a. On the other hand, if your father has enough income to qualify for himself (assuming he's single) and the intending immigrant on his own, you do NOT count your father in YOUR household size and he does NOT count you in his. In that case you EACH provide an I-864 and DO NOT combine income.

I think the earlier responses neglected to consider that you said you needed to combine income. Perhaps you do and perhaps you don't.

His current income is what will qualify him. Only if he is self employed would the income from his last tax return also be his "current income".
